O RDINANCE NO. 82 -15
AN ORDINANCE PROVIDING THAT THE 800 BLOCK OF CLINT
STREET AND THE 1000 BLOCK OF SHADY OAKS DRIVE BE
VACATED, ABANDONED AND CLOSED; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING FOR EFFECTIVE DATE.
THAT:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS,
Section 1. The 800 block of Clint. Street shall .be, and the same: is herel
closed, abandoned and permanently vacated as a street or public thoroughfare of
any kind or character whatsoever.
Sec 2 . The 1000 block of Shady Oaks Drive shall be, and the same is
hereby closed, abandoned and permanently vacated as a street or public
thoroughfare of any kind or character whatsoever.
Se ction 3 . All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
Sec 4 . This Ordinance shall be iii full force; and effect from and after the
date of, its passage, and it is so ordained.
PASSED IN OPEN SESSION of the City Council of the City of Kennedale. Texas,

SPECIAL MEETING KENNEDALE CITY COUNCIL
NOVEMBER 3, 1982
Mayor Radakovich assembled the meeting at 7: P. m.
Members present were Mayor Steve Radakovich, Mayor Pro -Tem
�.IWayne Winters, Councilmembers Allan Elrod, Dorothy Cooper
and Dwight Miller.
.;r '.Councilman Doyle Riley was absent.
;' Staff present were Mel Justice and Tyne Reflogal.
Item No. 1: CONSIDERATION OF LONE STAR GAS COMPANY RATE
INCREASE.
A. Z. Drones of Lone Star Gas Company asked Council to recon-
sider the gas rate denial and to suspend the action until No-
vember 30, 1982, so all seventeen cities of the district would
have the 'same action taken.
Wayne Winters made a motion to revoke the denial and to suspend
action for 120 days from August 2, 1982 to November 30, 1982,
seconded by Dorothy Cooper. Motion carried with none opposed.
Item No. 2: CONSIDERATION OF CLOSING PORTIONS OF CLINT STREET
'AND SHADY OAKS DRIVE IN HILLDALE ADDITION.
.Mel Justice explained that Mr. Couch wanted to close Clint and
a portion of Shady Oaks. Mr. Couch owns all the land adjacent
to the subject streets.
Winters made a motion to close the 1000 block of Shady
Oaks and the 800 block of Clint, seconded by Dorothy Cooper.
Motion carried with none opposed.
; No. 4':• DISCUSSION OF YARD BUILDING REQUIREMENTS.
Mayor Radakovich reported the building plans submitted by Mr.
Cooper for a permit for 345 and 347 Spring Branch Lane did not
meet building requirements. His plans were for a 17 foot back -
yard and the ordinance requires a 25 foot backyard.
.: Mr. Cooper stated that with 25 foot backyards he could only
;..build houses with 910 square feet and he wanted to build 1,100
square foot houses. Mr. Cooper requested Council to change the
ordinance allowing 15 foot backyards for A -1 Zoning District.
.Wayne.'Winters made a motion' to instruct Mel Justice to start
proceedings to 'change the yard requirements for A -1 Zoning
Districts,. seconded by' Dwight' Miller. Motion carried with
none, opposed.
A joint public hearing with the Planning and Zoning Board and
the City Council was scheduled for November 29, 1982, at
7:30 P. m.
Motion was made by Robert Brown, seconded by Mike Smith, to
accept the final plat. Four voted in favor of the request;
Raymond Morris and R. R. Flowers opposed and Glynn Cavasos
abstained.
b. Gary Cooper - Spring Branch Subdivision - presented
a Preliminary Plat on Phase II for the Board's consideration.
Raymond Morris stated that there would be no ruling on the above
item at this time. Mel Justice requested a letter be sub -;
mitred with all plats.
IV. Replatt:ing
a. Gary Cooper submitted a request for replatting of a
portion of Block 1, Pine Meadow Addition, for the purpose of
indicating the easement between Lots 12 -R and 13 -R has been
designated to include use as a drainage and utility easement.
Previous plat listed this as a utility easement only.
Motion was made by R. L. Flowers seconded, by Walter Billingsley,
to accept the replatt:ing in the drainage and utility easement.
Motion carried with none opposed.
V. Miscellaneous
a. Mrs. Turk Gibson - 915 Little Road - requested permission
to move a 5 -room house into Kennedale. R. F. Flowers stated
square feet does not meet city ordinances having 1,100 square
feet instead of 1,250 square feet required. Raymond Morris asked
if the property would be replatted. Mr. Gibson stated he would
have it replatted and any other changes required.
Motion made by Bill Cromer seconded by Robert Brown to approve
the moving of the house, contingent on property being replatted.
Motion carried with none opposed.
b. J. T. Couch requested closing of the 1000 block of
Shady Oaks Drive and the 800 block of Clint Street in the Ililldali
Addition.
Motion was made by R. E. Flowers, seconded by Robert Brown that,
upon payment of all taxes due by Mr. Couch, recommendation will
be made to the Council by Mel Justice for the closing of the 1000
block of Shady Oaks Drive and 800 block of Clint Street. Motion
carried with none opposed.
VI. Board Members
a. R. F. Flowers resigned from the Planning and Zoning Board,
Mr. flowers stated that he had enjoyed serving as a member of the
Board.

Attached is a request from Mr. J. T. Couch for the closing
of the 1000 block of Shady Oaks Street and the closing of
the 800 block of Clint Street, bounded by Lots 1 thru 8,
Block 6; Lots 2 thru 11, Block 7;and Lots 1 thru 5, Block
8; all in Hilldale Addition. Mr. Couch indicates he is
requesting these closing to replat Blocks 7 and 8 and a
portion of Block 6 into one large tract.
Since all property adjacent to these porlGioi of Shady Oaks
and Clint Street is the property of Mr. Couch, it was not
necessary to hold a Public Hearing on this since there are
no other adjacent owners.
Subject streets are dedicated but have never been opened and
subject area is covered with grasses and small trees. Since
Mr. Couch did not formally request replatting of subject
property at this time the staff does not know when this request
will be submitted. However, should the Board recommend the
closing of the streets the replatting of the area would be
germane to this request.
A review of tax records indicates Mr. Couch is delinquent on
payment of taxes on lots in these three blocks and the following

is the amount due in each instance:
Block 6 - $ 49.17
Block 7 - 180.61
Block 8 - 94.17
Total $323.95
Should approval of these street closings be given, it is
recommended such closings be contingent on all taxes being
paid up - to -date.
