AN ORDINANCE PROVIDING THAT THE PROVISIONS OF ARTICLES
1 AND 2, OF THE TAX RELIEF AMENDMENT IMPLEMENTATION
ACT ADOPTED BY THE 66TH TEXAS LEGISLATURE (HOUSE BILL
NO. 1060), SHALL NOT APPLY TO AD VALOREM TAXES IMPOSED
BY THE•CITY OF KENNEDALE, TEXAS, FOR THE 1979 TAX YEAR.
WHEREAS, Articles 1 and 2 of the Tax Relief Amendment
Implementation Act (House Bill No. 1060), adopted by the 66th
Texas Legislature, provide for special appraisal and valuation
procedures with respect to "open space land" devoted to agricul-
tural use, and to "timberland," as defined in said Act, for ad
valorem tax purposes for the 1979 and subsequent tax years; and
WHEREAS, Article 13, Section 1(b), vests the governing
body of a taxing unit with authority to postpone the application
of Articles 1 and 2 of said Act until the-1980 tax year, if
implementation of such procedures are not feasible in the opinion
of the governing body for the 1979 tax year; and
WHEREAS, the City Council of the City of Kennedale,
Texas, finds that it is not feasible to implement such special
appraisal and valuation procedures for said lands, if any, within
the City of Kennedale for application to its municipal ad valorem
taxes for the 1979 tax year; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. That the provisions of Articles 1 and 2 of the
Tax Relief Amendment Implementation Act (House Bill No. 1060),
enacted by the 66th Texas Legislature, which said Articles 1 and
2 are codified as Articles 7174A and 7174B, of Chapter 6, Title
122, Revised Civil Statutes of Texas, 1925, as amended, shall
not apply to 1979 ad valorem taxes assessed by the City of
Kennedale, Texas.
2. That said provisions (that is, Articles 7174A
and 7174B, Texas Revised Civil Statutes as amended) shall take
effect and apply to ad valorem taxes assessed or imposed by the
City of Kennedale, Texas; for the 1980 and subsequent tax years
