AN ORDINANCE OF THE CITY OF KENNEDALE, TEXAS, RE-
PEALING THE TAXES IMPOSED BY THE LOCAL SALES AND
USE TAX ACT (ARTICLE 1066c, VERNON'S TEXAS CIVIL
STATUTES) ON THE SALE AND DISTRIBUTION OF GAS AND
ELECTRICITY FOR RESIDENTIAL USE IN SAID CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
Section 1. Effective October 1, 1979, the City of Kenne-
dale, Texas, by majority vote of its governing body, hereby votes
to abolish and repeal the taxes authorized by the Local Sales And
Use Tax Act (Article 1066c, Vernon's Texas Civil Statutes) on the
receipts from the sale, production, distribution, lease or rental
of, and the use, storage, or other consumption of gas and electri-
city for residential use, as authorized by Section 6 of House Bill
No. 1, Acts 1978, 65th Legislature, Second Call Session.
Section 2. The abolition of such tax, as aforesaid, will
become effective on October 1, 1979, and until such date, the tax
will continue in effect as heretofore existing.
Section 3. The City Secretary shall transmit a certified
copy of this Ordinance to the Texas State Comptroller's Office,
immediately upon its passage, and in all events, prior to May 1,
1979.
