CITY OF KENNEDALE-ORDINANCE NO. 78-9
AN ORDINANCE AMENDING CHAPTER 3 OF THE CITY OF
KENNEDALE CODE 1977, SAID CHAPTER 3 BEING
ENTITLED "BUILDING, PLUMBING AND ELECTRICAL
INSTALLATIONS"; AND THIS AMENDMENT ADDING A
PROVISION TO SAID CHAPTER TO REQUIRE THE FILING
OF A BOND WITH THE CITY BY ANY PERSON OR
CORPORATION CONSTRUCTING, INSTALLING OR REPAIRING
SWIMMING POOLS OR AIR CONDITIONING SYSTEMS, OR
PARTS THEREOF, IN SAID CITY, AS A CONDITION
PRECEDENT TO THE ISSUANCE OF PERMITS FOR SUCH
WORK.
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. Chapter 3, entitled "BUILDING, PLUMBING
INSTALLATIONS," of THE KENNEDALE CITY CODE 1977, is
by adding to said chapter an additional article, to
Article 7, and entitled "Bond Required For Swimming
Air Conditioning Systems," which additional article
follows:

"Art. 7. Bond Required For Swimming
Pools And Air Conditioning Systems
"Previous provisions of Chapter 3 notwithstanding,
it shall be unlawful for any person or corporation to construct,
install or repair any swimming pool in the City of Kennedale, or
any air conditioning system, or parts thereof, in the City of
Kennedale, without first having filed with the City Secretary a
performance and indemnity bond in the sum of $3,000.00, by a
bonding company or sureties approved by the City Secretary, to
guarantee the construction, installation and repair of any
swimming pool, or any air conditioning system or parts thereof,
by the principal on the bond, in conformity with the provisions
of the Building, Plumbing and Electrical Codes of the City of
Kennedale, Texas, and any other applicable ordinances of said
City, and indemnifying the City, its officers and employees, from
any claims of liability whatsoever by reason of any failure to
so construct, install or repair such swimming pools or air
conditioning systems. It is the intent to require separate bonds
of swimming pool contractors and air conditioning system
contractors, who engage in such work within the corporate limits
of the City of Kennedale, Texas, and they are both mentioned in
this ordinance only for convenience and brevity. The filing and
approval of such bond shall be a condition precedent to the
issuance of a permit for the work referred to in this ordinance."
2. Except as hereby expressly amended, said Chapter 3
of the Kennedale City Code 1977 shall continue in full force and
effect as heretofore existing - that is, as originally enacted
in said Code, and as heretofore amended.
3. This ordinance shall be in full force and effect
immediately upon its passage and approval.
