AN ORDINANCE PROVIDING THAT A SERVICE CHARGE WILL BE
MADE BY THE CITY OF KENNEDALE, TEXAS, FOR THE HANDLING
OF ALL CHECKS AND DRAFTS PAID TO THE CITY OF KENNEDALE,
ON WHICH PAYMENT IS REFUSED UPON PRESENTATION TO THE
PAYOR'S BANK.
WHEREAS, the handling of checks or drafts tendered the
City of Kennedale in payment for municipal services, charges,
taxes and other revenues due the City, on which payment is
refused on presentation to the payor's bank, has proved time-
consuming and expensive, and the City QQuncil deems it to be
in the interest of the City and its citizens that the expense
of the handling of such checks and drafts for redemption should
be borne by the person tendering such checks and drafts, rather
than the general revenues of the City; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. That a service charge of $5.00 shall be collected by
the City of Kennedale for the handling for redemption of any
check or draft tendered the City in payment of any revenues due
the City, if payment of such check or draft is refused for any
reason by the payor's bank on which the check is drawn.
2. That said service charge will be due regardless of
whether the dishonored check was tendered in payment of taxes,
Municipal Court fines, building peiiuits, inspection fees,
water or sewer charges, or for any other sums due the City of
Kennedale.
3. That such service charge will be due the City of
Kennedale regardless of whether the drawee-bank's refusal to
make payment thereon is due to insufficient funds, a stop
payment order, error in the manner of writing the check or
draft, or for any other reason.
4. The service charge herein provided is to help defray
the expense to the City in the handling of such items, and
will accrue and become due at any time that it is necessary
for the City or its officers to notify the person who tendered
the check or draft of its dishonor, regardless of whether the
check is redeemed by the person tendering same or upon such
person's instruction, redeposited for collection. If such
redeposit, upon the request or instruction of the person
tendering same, shall result in a second refusal of payment
on the same check or draft, then an additional service charge
of $5.00 will be due for such second refusal and the resulting
handling. If, however, the City redeposits a dishonored draft
on the City's own initiative, without notice to or instruction
from the maker, then the service charge will not be due,
provided such redeposit results in collection.
5. This ordinance shall be in force immediately upon
its passage and approval.
