AN ORDINANCE AMENDING ARTICLE 1 OF CHAPTER 14 OF
THE KENNEDALE CITY CODE 1977, PERTAINING TO THE
KENNEDALE WATER SYSTEM; SUCH AMENDMENTS INCREASING
THE REQUIRED DEPOSIT FOR WATER SERVICE THROUGH A
THREE -FOURTHS INCH METER OR LESS, INCREASING THE
CHARGE FOR RECONNECTION AFTER DISCONTINUANCE OF
WATER SERVICE, AND PROVIDING FOR A HEARING BEFORE
DISCONTINUANCE OF SERVICE FOR NON-PAYMENT OF
BILLS THEREFOR..
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. Section 14-1, entitled "Water Rates; Utility Bills,"
of Article 1, of Chapter 14 of the Kenndale City Code 1977, is
hereby amended as to Subsection (d) of said Section 14-1 only,
so that said Subsection (d) shall hereafter read as follows:
"All bills for City utilities rendered by the City
of Kennedale shall be paid monthly by the loth day of the month
after the billing date. If such bills are not paid by the
20th day of said month, a 10% penalty will be added for late
payment. If the bill is not paid by the loth day of the following
month, the service shall be subject to discontinuance, and water
and sewer services are indivisible in this regard, so that
non-payment for either service will justify discontinuance of
both services. Before discontinuing service, however, the using
person will be given notice in writing, either by separate
postcard or letter or by stamped or printed notice on a water
bill to the customer, that service will be discontinued unless
the customer appears at a hearing,at a time designated not less
than five days after the mailing or other personal delivery
of said notice, and shows just cause why the service should
not be discontinued. Such hearing shall be conducted at the
City Hall by the City Secretary and City Water Superintendent,
or in event of necessary absence of either, by the other of
said two officials. If the customer fails to appear for such
hearing, or appearing fails to show just cause for delay, the
service shall thereafter be promptly disconnected until the
delinquencies are all paid. If good cause for delay is shown,
the hearing officials may withdraw the discontinuance notice,
or defer discontinuance under conditions deemed fair and just
in light of the evidence presented at such hearing."
2. Section 14-2, entitled "Minimum Monthly Utility
Charges; Discontinuance; Water Deposit," of Article 1, of
Chapter 14 of the Kennedale City Code 1977, is hereby amended
in the following particulars only:
(a) Subsection (b) of said Section 14-2,
is hereby amended to increase the charge
for reconnection of water or sewer service
after discontinuance for non-payment to the
sum of $10.00, rather than $5.00 as hereto-
fore provided in said subsection.
(b) Subsection (d) of said Section 14-2,
is hereby amended to increase the deposit
required for beginning water service
through a three -fourths inch meter or
smaller to the sum of $25.00, rather than
$20.00 as heretofore provided in said
subsection.
3. Except as hereinabove expressly amended, both
Sections 14-1 and 14-2, of Article 1, of Chapter 14 of
the Kennedale City Code, 1977, are hereby continued in full
force and effect as heretofore existing.- that is, as
originally adopted in said Kennedale City Code 1977, or
heretofore amended.
