CITY OF KENNEDALE ORDINANCE NO. 78-4 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OF KENNEDALE, TEXAS, AND LYING EN- TIRELY WITHIN ITS EXCLUSIVE EXTRATERRITORIAL JURISDICTION. WHEREAS, after due notice and public hearing as prescribed by law, the City Council has, determined that all requirements of the Texas Municipal Annexation Act are complied with and that it will be to the best interest of the City of Kennedale and its in- habitants, as well as the in habitants of the territory hereinafter described, that said land and territory be annexed to and brought within the corporate limits of said City of Kennedale, Texas; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: SECTION ONE. That the land and territory hereinafter de- scribed, lying entirely within the exclusive extraterritorial jur- isdiction of the City of Kennedale, Texas, and being adjacent and contiguous to existing boundaries of said City, and within one-half mile thereof, be and the same is hereby annexed to and brought with- in the corporate boundaries, and hereby made an integral part of the City of Kennedale, Texas, such land and territory hereby annexed be- ing described by metes and bounds as follows, to -wit: BEING a tract of land out of the M. F. Scott Survey, Ab- stract No. 1450, in Tarrant County, Texas, and being a portion of a 5.0 acre tract of land described in a deed from Toimaie L. Gay et ux. to Joe B. Anderson et ux., recorded in Vol 4616, page 390, of the Deed Records of Tarrant County, Texas, and more particularly de- scribed by metes and bounds as follows: BEGINNING at the NW corner of said 5.0 acre tract as describ- ed in said Vol. 4616, page 390, Tarrant County Deed Records: THENCE S 3 degrees, 44 minutes, 30 seconds W 100 feet along the E line of Susan Drive to an iron pin for corner; THENCE N 89 degrees, 19 minutes, 0.2 seconds E 199.72 feet to an iron pin for corner; THENCE N 3 degrees, 42 minutes, 18 seconds W 99.91 feet to an iron pin for corner in the N line of said 5.0 acre tract; THENCE S 89 degrees, 13 minutes, 30 seconds E along the N line of said 5.0 acre tract 200.43 feet, more or less, to the place of beginning; and being 0.471 acres of land, more or less, and all of the NW quarter of said original 5.0 acre tract not heretofore annexed by the City of Kennedale, Texas, by its Ordinance No. 77-16, dated October 13, 1977, and recorded in Vol. 6358, page 550, of the Deed Records of Tarrant County, Texas. SECTION TWO. That the owners and inhabitants of the property above described and hereby annexed be, and they are hereby declared entitled to all the rights and privileges of other property owners and citizens of the City of Kennedale, Texas, and shall henceforth be bound by all of the acts and ordinances of said City of Kennedale, Texas, which are now in force and effect, and which shall be hereaf- ter adopted. SECTION THREE. That the official boundaries of the City of Kennedale, Texas, as heretofore adopted and amended, be and they are hereby corrected and amended, so as to include the above describ- ed area and territory as a part of the City of Kennedale, Texas. CO -Linea dedicated and he thought that what has been is sufficient for the city to accept the road. He said that he would like to file an amendment to make it absolutely clear. The council voted to recognize the original dedication. Herman Sullivan then came before the council to petition the city of Kennedale to annex his house at 403 Susan Drive, which he is selling to Mr. and Mrs. Mark Dooley. City attorney Marshall said that there would have to be a public hearing at the next regular meeting. Councilmen Jernigan and Winters recommended that the city inspect the house before an- nexing it. The council agreed that the public hearing would be at the next regular meeting and that Dooley would have a temporary permit to use city water. Mayor Radakovich then reported to the council on some old business. He said that he had contacted the Mayor of Pantego about the dispatching a matter discussed at last month's meeting, 4 but has had no word yet from the city. He also reported that no action had been taken at this time con- cerning the dissolving of the MRDA. Radakovich said that he had talked to the mayor of Lake City Village about that area possibly being annexed to Ken- nedale. City attorney Marshall said that there would have to be a petition coming from the area before such a possibility could exist. City councilwoman Sanderson drew the council's attention to the poor ambulance service being received by the city, citing several in- stances where calls were not answered by Mid -Cities Am- bulance Service. Mayor Radakovich said that the city is holding back their money because they haven't submitted a monthly report for several months. He said that he has called Mid -cities three times and hasn't gotten a response. The council agreed to have the Mayor check into other services.
