O77-09Dell 9 9 0 .E CITY OF KENNEDALE ORDINANCE NO. 77-9 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OF KENNEDALE, TEXAS; PROVIDING THAT SUCH AREA IS HEREBY MADE A PART OF SAID CITY AND THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO ALL PRIVILEGES OF OTHER PROPERTY OWNERS AND CITIZENS OF SAID CITY, AND SHALL BE BOUND BY ALL ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED; FURTHER PROVIDING FOR THE AMENDING AND CORRECTING OF THE OFFICIAL BOUNDARIES OF SAID CITY AS HERE- TOFORE ADOPTED AND AMENDED, TO INCLUDE SAID LAND AND TERRI- TORY; AND FOR AN EFFECTIVE DATE. WHEREAS, after due notice as required by the Texas Municipal Annexation Act, the City Council of the City of Kennedale, Texas, has duly held Public Hearing on the question of whether said City shall institute annexation proceedings on the hereinafter described property and territory, giving all interested persons an opportunity to be heard at such hearing; and WHEREAS, said City Council, after Public Hearing and within the time prescribed by law, has determined that it will be in the best interest of said City of Kennedale, Texas, its inhabitants and the owners and inhabitants of the hereinafter described territory, that such land and territory be annexed to the City of Kennedale, Texas; and WHEREAS, at a regular meeting on this loth day of March, 1977, said City Council has duly considered such proposed annexation, and finds that all the territory hereinafter described is situated exclusively within the extraterritorial jurisdiction of the City of Kennedale, that it is adjacent and contiguous to existing boundaries of said City, that it is not more than one-half mile in width, that all owners thereof have made written application as by law provided for the annexation of same to said City, and that all statutory requirements and conditions for annexation of said territory have been fulfilled; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. That the land and territory hereinafter described lying entirely within the extraterritorial jurisdiction of the City of Kennedale, Texas, and being adjacent and contiguous to existing boundaries of said City, be and the same is hereby annexed to and brought within the corporate boundaries, and hereby made an integral part of the City of Kennedale, Texas, such land and territory hereby annexed being described by metes and bounds as follows, to -wit: BEING land which is . part of Tract 9, J. M. Estes Home Tracts, out of the J. M. Lilly Surveys, Tarrant County, Texas, as recorded in Volume 1857, Page 283, Deed Records of Tarrant County, Texas, described as follows: BEGINNING at a point in the West line of Tract 9, J. M. Estes Home Tracts, 900 feet South of the Northwest corner of said Tract 9, same being the point of intersection of a present Southerly corporate limit line of Kennedale with the West line of said Tract 9; THENCE Southerly with the fence and said West line of said Tract 9 100 feet to an iron pin for corner; THENCE Easterly 122.1 feet parallel with the North line of said Tract 9 and County Road No. 2056 to an iron pin for the Southwest corner of the tract hereby annexed; THENCE Easterly 122.1 feet, parallel with the North line of Tract 9 and County Road No. 2056, to an iron pin for the Southeast corner of the tract hereby annexed; THENCE Northerly 100 feet to a point in an existing Southerly corporate limit line of the City of Kennedale, Texas; VOL THENCE Westerly with the existing corporate limit line of the City of Kennedale 118.9 feet to the place of beginning; IT BEING THE INTENTION to here describe all of that certain 0.55 acre tract of land owned by Linda Miller in said Tract 9, J. M. Estes Home Tracts, which is not already within the existing corporate limits of the City of Kennedale, Texas, it being the understanding of the Kennedale City Council that the North 100 feet of her tract is already within Kennedale, but if the metes and bounds description is not sufficient to include all of Linda Miller's said tract not already within the City of Kennedale, then same is hereby amended to include all of said 0.55 acre tract of Linda Miller, out of the said Tract 9, J. M. Estes -Home Tracts, which was not previously a part of the corporate boundaries of the City of Kennedale, Texas. Section 2. That the owners and inhabitants of the property above described and hereby annexed to be, and they are hereby declared entitled to all of the rights and privileges of other property owners and citizens of the City of Kennedale, Texas, and shall henceforth be bound by all of the Acts and Ordinances of said City of Kennedale, Texas, which are now in force and effect, and which may be hereinafter adopted. Section 3. That the official boundaries of the City of Kennedale, Texas, as heretofore adopted and amended, be and they are hereby corrected and amended, so as to•include the above described area and territory as a part of the City of Kennedale, Texas. Section 4. That this Ordinance shall become effective from and after its passage and approval by the Mayor, duly attested by the City Secretary. ADOPTED AND APPROVED this 10th day of March, 1977.
