CITY OF KENNEDALE ORDINANCE NO. 77-8
AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND
CONTIGUOUS TO THE CITY OF KENNEDALE, TEXAS; PROVIDING THAT
SUCH AREA IS HEREBY MADE A PART OF SAID CITY AND THE OWNERS
AND INHABITANTS THEREOF SHALL BE ENTITLED TO ALL PRIVILEGES
OF OTHER PROPERTY OWNERS AND CITIZENS OF SAID CITY, AND SHALL
BE BOUND BY ALL ACTS AND ORDINANCES NOW IN EFFECT AND TO BE
HEREAFTER ADOPTED; FURTHER PROVIDING FOR THE AMENDING AND
CORRECTING OF THE OFFICIAL BOUNDARIES OF SAID CITY AS HERE-
TOFORE ADOPTED AND AMENDED, TO INCLUDE SAID LAND AND TERRI-
TORY; AND FOR AN EFFECTIVE DATE.
WHEREAS, after due notice as required by the Texas Municipal
Annexation Act, the City Council of the. City of Kennedale, Texas, has
duly held Public Hearing on the question of whether said City shall
institute annexation proceedings on the hereinafter described property
and territory, giving all interested persons an opportunity to be heard
at such hearing; and
WHEREAS, said City Council, after Public Hearing and within
the time prescribed by law, has determined that it will be in the best
interest of said City of Kennedale, Texas, its inhabitants and the
owners and inhabitants of the hereinafter described territory, that
such land and territory be annexed to the City of Kennedale, Texas;
and
WHEREAS, at a regular meeting on this l0th day of March,
1977, said City Council has duly considered such proposed annexation,
and finds that all the territory hereinafter described is situated
exclusively within the extraterritorial jurisdiction of the City of
Kennedale, that it is adjacent and contiguous to existing boundaries
of said City, that it is not more than one-half mile in width, that
all owners thereof have made written application as by law provided
for the annexation of same to said City, and that all statutory
requirements and conditions for annexation of said territory have been
fulfilled; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
Section 1. That the land and territory hereinafter described
lying entirely within the extraterritorial jurisdiction of the City of
Kennedale, Texas, and being adjacent and contiguous to existing boundaries
of said City, be and the same is hereby annexed to and brought within the
corporate boundaries, and hereby made an integral part of the City of
Kennedale, Texas, such land and territory hereby annexed being described
by metes and bounds as follows, to -wit:
BEING part of Lots.5 and 6, of the W. J. Boaz Estates Subdivision,
out of the M. F. Scott Survey, Tarrant County, Texas, according
to plat recorded in Volume 1383, Page 588, Deed Records of
Tarrant County, Texas; the portion of Lot 5 being described as
follows:
BEGINNING at an iron pin situated in the Southeast corner
of said Lot 5 and also being the West right-of-way line of
an existing gravel road;
THENCE North along said right-of-way line of said gravel
road, 200.0 feet to an iron pin for corner;
THENCE West 958.0 feet to an iron pin for corner;
THENCE South 150.0 feet to an iron pin for corner;
THENCE West passing an iron pin at a distance of 385.0 feet,
continuing in all 400 feet to a point for a corner;
THENCE South 50.0 feet;
THENCE East passing an iron pin at a distance of 15.0 feet,
continuing in all 1358.0 feet to the place of beginning,
and containing 4.866 acres of land, more or less;
AND the portion of Lot 6 being described as follows:
BEGINNING at an iron pin situated at the Southeast corner

of said Lot 6 and also being in the West right-of-way
line of an existing gravel road;
THENCE North along said right-of-way line of said
gravel road, 200.0 feet to an iron pin for corner;
THENCE West 1089.7 feet to an iron pin for corner,
being in the centerline of a 10 feet sanitary
sewer easement;
THENCE South 20° 38" East along the centerline of
said easement, 211.8 feet to an iron pin for corner;
THENCE East 1012.4 feet to the place of beginning,
and containing 4.82 acres of land, more or less;
TOGETHER with the portion of said above mentioned
public gravel road abutting and adjoining such
portions of both said Lots 5 and 6, W. J. Boaz
Estates Subdivision, as hereinabove described, and
(or so much thereof as is not already within the
corporate limits of the City of Kennedale, Texas
prior to the adoption of this Ordinance).
Section 2. That the owners and inhabitants of the property
above described and hereby annexed to be, and they are hereby declared
entitled to all of the rights and privileges of other property owners
and citizens of the City of Kennedale, Texas, and shall henceforth be
bound by all of the Acts and Ordinances of said City of Kennedale,
Texas, which are now in force and effect, and which may be hereafter
adopted.
Section 3. That the official boundaries of the City of
Kennedale, Texas, as heretofore adopted and amended, be and they
are hereby corrected and amended, so as to include the above described
area and territory as a part of the City of Kennedale, Texas.
Section 4. That this Ordinance shall become effective from
and after its passage and approval by the Mayor, duly attested by the
City Secretary.

PETITION FOR ANNEXATION
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS:
We, the undersigned, being all of the owners of the
herein described property, hereby petition the Mayor and City
Council of the City of Kennedale, Texas, to institute all
proceedings and adopt the necessary ordinance, and do all
things necessary to annex the said herein described real
property, land and territory by the City of Kennedale and make
same a part of the corporate area of said City, such land and
territory being more particularly described as follows, to -wit:
TRACT ONE: BEING a part of Lot 5 of the W. J. Boaz Subdivision
being a part of the M. F. Scott Survey, Tarrant County, Texas,
according to plat recorded in Volume 1383, Page 588, Deed Records
Tarrant County, Texas, and being described as follows:
BEGINNING at an iron pin situated at the Southeast corner of said
Lot 5 and also being the West R.O.W. line of an existing gravel
road;
THENCE North along said R.O.W. line of gravel road, 200.0 feet to
an iron pin for corner;
THENCE West 958.0 feet to an iron pin for corner;

THENCE West 1089.7 feet to an iron pin for corner being in the

THENCE South 20 degrees 38 minutes East along centerline of said
easement, 211.8 feet to an iron pin for corner;
THENCE East 1012.4 feet to the place of BEGINNING and CONTAINING
4.82 acres of land.
Petitioners show and represent that said land and
territory above described is contiguous and adjacent to the
existing corporate limits of the City of Kennedale, Texas, is
less than 1/2 mile in width, is not now a part of any other
municipality, and lies entirely within the extra -territorial
jurisdiction belonging exclusively to the City of Kennedale, and
that the undersigned are all of the persons owning any interest in
said land and territory; that a portion of the above described land
is perhaps already within the incorporated limits of the City of
Kennedale, Texas, as now existing, but petitioners desire all of
such described land as in not now a part of said City to be annex-
ed thereto and brought within the corporate limits of the said
City of Kennedale, Texas.
