AN ORDINANCE ESTABLISHING RULES AND REGULATIONS
FOR THE MOVING OF ANY RESIDENTIAL, COMMERCIAL OR
OTHER BUILDING OR STRUCTURE WITHIN OR FROM WITH-
OUT TO A LOCATION WITHIN THE CITY OF KENNEDALE,
TEXAS; REQUIRING A PERMIT THEREFOR; ESTABLISHING
PENALTIES FOR THE VIOLATION THEREOF; CONTAINING
A SAVINGS CLAUSE AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
SECTION 1. APPLICATION
It shall be unlawful to move any building or other
structure, whether residential, commercial or otherwise, and
whether new or used, from without the City of Kennedale to
any location within the City of Kennedale, Texas, or from one
location to another within the City of Kennedale, Texas, without
first having applied for and obtained issuance of a permit for
such moving as prescribed in this Ordinance.
SECTION 2. APPLICATION
(a) An application to move any building or structure,
as above defined, for intended occupancy within the City of Kennedale,
Texas, must be submitted to the City Secretary on a form provided by
the City, and must be signed by a City of Kennedale Licensed and
Bonded House Mover. Said application shall provide information
necessary for the City Secretary, Building Inspector and Planning and
Zoning Board to pass on the matters required by this Ordinance, by
study and review of the application. A non-refundable fee of $50.00
shall be paid to the City on submission of the application, and shall
be separate from other fees incurred in placement and approval of the
building or structure.
(b) Each application for the moving of a building or
structure shall be reviewed by the Planning and Zoning Board for
its determination as to whether the building meets the regulations
set forth in this Ordinance, as well as'any other applicable Ordinance
of the City. The Planning and Zoning Board shall approve or deny the
issuance of a building permit based on its review.
(c) A plot plan shall be submitted with the application,
showing the shape and dimensions of the lot to be occupied by the
structure, location of the structure on the lot, and sufficient
information to show that yard requirements, square footage requirements
of the building, and all other subdivision, building and zoning require-
ments of the City of Kennedale are to be complied with, the same as for
a built -on -the -site structure.
(d) The applicant must provide, with the application, color
photographs of the structure to be moved, taken from the front, back
and both sides. The photographs should attempt to truly reflect the
appearance, size, dimensions and structural quality of the house.
SECTION 3. REGULATIONS
(a) The applicant shall provide, with the application,
a building plan of the proposed improvements (that is, the plans for
completion of the structure after being moved onto a site), including
a site plan, and the total estimated cost to bring the structure into
compliance with City of Kennedale Building, Planning, Electrical and
any other applicable Codes and/or Ordinances. The moved -in structure,
at time of occupancy, must be of equal or greater size, quality, value
and appearance to other structures located within 200 feet of the lot
on which it is to be located. The accomplishment of these ends must be
reflected by the submitted plans before a permit will be issued.
(b) The application must show that the moved -in structure
is to be located on a platted lot in a subdivision approved by the
Planning and Zoning Board, and of record in the Office of the Tarrant
County Clerk.
(c) If a public sewer main is available within 100 feet of
the lot on which the moved -in structure is to be located, it must be
connected to the public sewer main. If such sewer is not so available,
a septic tank will be permissible, provided it is on a lot having a
minimum area of 20,000 square feet, a soil percolation test approved
by the State and County Health Offices is submitted with the application,
and the septic tank is completed in confoLmity with State, County and
City standards and requirements.
(d) The Building Inspector shall make the following
inspections of the moved -in structure after its location and during
its improvement for occupancy:
(1) Plumbing rough -in;
(2) Foundation before pouring;
(3) If room or structural changes
are contemplated, framing and
electrical before sheetrock
installation;
(4) Any and all electrical, before
covering;
(5) Final plumbing;
(6) Final electric;
(7) Final over-all inspection,
which shall be made within 90
days from the date the structure
is moved onto the lot site.
(e) After the final over-all inspection, the Building
Inspector may issue a Certificate of Occupancy if all requirements
of this and other applicable Ordinances and Codes of the City are
met. If not, he shall specify inadequacies to be completed, which
inadequacies must be remedied within the initial 90 day permit period.
(f) The final over-all inspection shall also take into
consideration the structure's general appearance, appearance in
relationship to structures within 200 feet of the lot on which the
moved -in structure is located, adequacy of provisions for driveway
and/or off-street parking, as well as all matters related to
inspection of buildings generally.
(g) All work accomplished on the structure shall be done
by a City of Kennedale licensed plumber and/or electrician, the same
as required for built -on -the -site structures.
(h) Any appeal from the Building Inspector's decisions
regarding final inspection shall be to the Planning and Zoning Board,
accomplished by written notice delivered to the City Secretary within
10 days following notice of the Inspector's decision, and said appeal
process will not be considered during the initial 90 day permit period.
(i) Temporary utility services shall be peiuiissible during
the 90 day peiuiit period, as required for construction and improvement
related to the moved -in structure; but utility connection and service
after the construction period shall be contingent on a Certificate of
Occupancy after approval by the Building Inspector.
SECTION 4. HOMEOWNER'S BOND
The applicant for a house moving permit shall present, with
the application, a performance bond provided and executed by the owner

of the structure to be moved, said bond to be in an amount equal to
one and one-half times the estimated cost of improvements, as provided
in Section 2(a) of this Ordinance, and shall be payable to the City of
Kennedale, Texas. Within 90 days from the date the building or
structure is moved onto the lot where it is to be located, such structure
must be in compliance with all provisions of this Ordinance, and the
City of Kennedale Building, Plumbling, Electrical, Zoning and all other
applicable Codes and/or Ordinances, and ready to occupy, with a Certi-
ficate of Occupancy issued therefor by the Building Inspector. Failure
to complete the structure within the specified time will result in
forfeiture of the bond.
SECTION 5. PENALTIES FOR VIOLATIONS
Violation of any provision of this Ordinance shall be deemed
a misdemeanor, and upon conviction thereof, any person, firm or
corporation violating the same, shall be fined in any sum not to
exceed $200.00. Each day that a violation of this Ordinance continues
shall be deemed a distinct and separate offense. The City of Kennedale
reserves and shall have the right to disconnect and discontinue utility
services to any structure in the City in violation of this Ordinance,
regardless of any other remedies available, and without resort to any
court proceeding, and without prejudice to any other remedy for the
violation of any provision of this Ordinance, whether criminal or
civil in nature.
SECTION 6. SAVING CLAUSE AND EFFECTIVE DATE
(a) This Ordinance shall be deemed cumulative of any other
Ordinances of the City on this subject, and shall repeal any part of
any existing Ordinance only to the extent that it is in necessary
conflict with such portion of an existing Ordinance.
(b) Each Section, paragraph, sentence, phrase and provision
of this Ordinance shall be deemed to constitute a separate Section,
paragraph, sentence, phrase or provision. The holding of any part of
this Ordinance to be unconstitutional or unenforceable for any reason
shall not affect the validity of any other portion of the Ordinance.
(c) This Ordinance shall be in full force and effect
iuuutediately upon its passage and approval, and publication as required
by law.
