AN ORDINANCE REPEALING THE PROVISIONS OF KENNEDALE
ORDINANCE NO. 57-9 RELATING TO PERMITS FOR HAULING
OF GARBAGE AND TRASH FOR THE PUBLIC; AND AMENDING
SAID ORDINANCE TO FORBID THE COLLECTION AND HAULING
OF GARBAGE AND TRASH FOR THE PUBLIC WITHIN THE CITY
OF KENNEDALE, TEXAS, EXCEPT PURSUANT TO FRANCHISE
THEREFOR GRANTED BY THE CITY COUNCIL OF THE CITY OF
KENNEDALE, TEXAS; PROVIDING A PENALTY FOR THE VIO-
LATION OF SUCH AMENDMENT, AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Kennedale, Texas,
after study, has determined that it will be in the best interest of
the citizens and inhabitants of the City of Kennedale, and promote
health, sanitation and the general welfare to limit and control the
business of collecting and hauling garbage and trash from premises
in the City of Kennedale, Texas, through franchise contracts therefor
with the City Council; now, therefore:
BE IT ORDAINED BY THE CITY OF COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. Sections 8, 9, 10, 11 and 12 of Kennedale Ordinance
No. 57-9 (also sometimes referred to,as Kennedale Ordinance No. 57-8BI
heretofore adopted by the City Council of the City of Kennedale, Texas,
on February 7, 1958- are hereby repealed. Said Kennedale Ordinance
No. 57-9 is an ordinance prescribing rules and regulations for the
collection and disposal of garbage and trash within the City, and the
said Sections 8 through 12, both inclusive, hereby repealed, are those
Sections of said Ordinance providing for issuance of permits by the
City Council to persons engaging in the business of collecting and
hauling garbage and trash from premises within the City of Kennedale.
2. Said Kennedale Ordinance No. 57-9 is hereby amended,
by addition thereto of the following Sections 8 and 9, in lieu of
former Sections 8, 9, 10, 11 and 12, hereby repealed, said amended
Sections to read as follows:
"Section 8. No person, firm or corporation shall engage
in the business of collecting, hauling and/or disposing of garbage
or trash from premises within the corporate limits of the City of
Kennedale, Texas, for the public for hire, unless such person, firm
or corporation has been granted a franchise agreement therefor by
the City Council of the City of Kennedale, Texas. The City Council
shall grant any such franchise upon the teLuis and conditions it finds
to be in the best interest of the City of Kennedale, its citizens and
inhabitants. Any franchise so granted may be made exclusive, or limited
to such numbers as the City Council shall deteLLnine to be warranted by
the public convenience and necessity, and best calculated to effect
regular and efficient garbage service and promote the general health,
sanitation and welfare."
"Section 9. Any person, firm or corporation, or agent thereof,
violating the preceding Section 8 by engaging in the aforesaid garbage
or trash collection business without such engagement being pursuant to
a franchise agreement from the Kennedale City Council, shall be deemed
guilty of a misdemeanor, and upon conviction thereof shall be fined in
any sum not to exceed $200.00, and each day that any such violation
continues shall be deemed to be a distinct and separate offense. In
addition, the City of Kennedale, Texas, may, at its option, abate such
violation by suit for injunction or any other remedy available to it at
law."
3. Except as hereby expressly repealed and amended, said
Kennedale Ordinance No. 57-9 is expressly continued in full force and
effect as heretofore adopted.
4. This amendment shall be in full force and effect immediately
upon its passage and approval.
