O77-19ORDINANCE NO. 77-19 AN ORDINANCE REGULATING CONDUCT IN PUBLIC PARKS; PROVIDING FOR ENFORCEMENT; AND PROVIDING PENALTIES FOR VIOLATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: SECTION 1. DEFINITIONS (a) "Board" is the Park Board of the City of Kennedale. (b) "Administrator" is the City Administrator as appointed by the City Council of the City of Kennedale, or the City Administrators' designated representative., (c) "Park" is a park, playground, recreation center, ball field area or any area in the City owned, used and designated by the City of Kennedale for recrea- tional purpose. SECTION 2. PARK PROPERTY No person in a park shall: (a) Willfully mark, deface, disfigure, injure, tamper with or remove or construct any building, bridge, table, bench, fireplace, signs, water or restroom facilities, or other structures or equipment, on park property. (b) Dig, injure,.or remove any soil, rock, trees, grass, shrubs, or plants, or make any excavation by any means. (c) Willfully interfere, disrupt, or prevent the orderly conduct of supervised play or program being conducted at a park. (d) Throw, discharge, or otherwise place in the water of any fountain, lake, or stream, any.substance which will result in pollution of said water. This rule shall forbid dumping, depositing, or leaving any bottles, broken glass, paper boxes, cans, rubbish or refuse or sewerage from recreational vehicles in any waters or grounds of any park. SECTION 3. TRAFFIC No person in a park shall: (a) Fail to comply with all applicable provision of the Texas Motor Vehicle Traffic Laws regarding operation of vehicles (b) Fail to obey all traffic officers and park employees, or other authorized persons instructed to direct traffic when needed in the parks and immediately adjacent. V(c) Fail to observe carefully all traffic signs indicating speed, direction, caution, stopping, and other posted notices for safety purposes. Speed limit within all parks shall be ten (10) M.P.H. (d) Drive, ride, or park any motor vehicle, bicycle or motorcycle, on any area except the paved park roads, or parking areas. 1?- SECTION 4. RECREATIONAL ACTIVITIES No person in a park shall: (a) Swim, or bathe in any water unless otherwise posted in any park. (b) Bring into or operate any power boat upon any waters in a park. (c) Hunt, trap, or pursue wildlife at any time. No personshalluse or carry firearms, air rifles, spring guns, bows, or any form of weapon potentially harmful to wildlife and dangerous to persons using the park. (d) Ride, lead, or drive a horse in the park. (e) Bring alcoholic beverages into a park, nor shall any person drink alcoholic beverages at any time in the park, or be under the influence of alcohol while within a park. (f) Build or attempt to build a fire except in designated areas. (g) Bring drugs, marijuana, or any other illegal substance within the park, or have in possession or use same within a park. SECTION 5. OPERATING POLICY (a) Except for unusual and unforeseen emergencies, parks shall be open to the public every day of the year during the hours of six o'clock A.N. until eleven o'clock P.M. except by special pe.mission of the Administrator. (b) Any section of any park may be declared closed to the public by the Administrator at any time for any interval of time. (c) No concession shall be conducted within any park without approval of the Board based upon type of concession, activity, and proceeds. If deemed appropriate by the Board, the Board may require a fee or other method of recompensation for consider- ation of allowing the concession. (d) The Administrator, or his designated representative, including police officers, shall have the authority to eject from any park any person acting in violation of this ordinance, or other rules as set forth by the Board. SECTION 6. PENALTY (a) Any person violating any provision of this ordinance shall upon conviction, be subject to a fine in any sum not to exceed $200.00.
