WHEREAS, the City of Kennedale is incorporated under
Chapters 1-10, Title 28, Revised Civil Statutes of Texas, and
can therefore adopt an ordinance that requires the demolition
or repair of a building that is dilapidated, substandard, unfit
For human habitation, or a hazard to Lhc health, safety, and
welfare of Kennedale reside►uLs,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
SECTION 1. STANDARDS, DEFINITIONS
(a) Within the scope of this ordinance a dilapidated
structure shall be defined as:
1. Dilapidated Structures. A structure which
is damaged, decayed, insanitary, unsafe, or
vermin -infected to such a degree as to create
a serious hazard to the health and safety of
the occupants or public. A structure which
lacks illumination, ventilation, sanitation,
heat, or other facilities adequate to protect
the health and safety of the occupants or
public.
(b) The owner, operator, or occupant of a structure
questioned to be dilapidated shall give the
authorized Building Official of the City of
Kennedale access to such structure for the purpose
of inspection at any reasonable time.
SECTION 2. NOTICE TO OWNER
(a) Whenever any structure exists in the City of Kennedale,
Texas, as defined by the provisions of this article,
the Building Official shall give written notice to
the owner, and occupant, if any, of the premises on
which such structure exists, which notice shall state
the nature of the structure and direct that it must
be removed and abated within ninety days and further
stating that a request for hearing, if desired, must
be made before expiration of ten -days from mailing
date; and the notice shall be mailed, by certified
or registered mail with a five-day return requested,
to the owner or occupant of the premises whereupon
such structure exists at least eleven days prior to
any action hereinafter authorized by the City of
Kennedale to abate such nuisance. If the notice is
returned undelivered by the United States Post Office,
official action to abate the nuisance shall be
continued not less than ninety days from the date of
such return.
SECTION 3._ PUBLIC HEARING
(a) Upon request in writing by the owner or occupant of the
premises where any structure under this article is
alleged to exist, such notice to be delivered to the
City Secretary, within ten days after service of notice
to repair or remove the structure, then a public
hearing shall be held before the City Council of the
City of Kennedale on the question of whether it should
be abated. Written notice of such public hearing shall
be directed by regular mail to the owner or occupant
requesting same, at the address shown on such request,
to be mailed at least five days prior to the hearing.,
After such hearing, the City Council shall determine
its finding by resolution; and if a nuisance
is found to exist and repair or removal is
ordered, such resolution shall include a
description of the needed repair, and shall
require the repair or removal within ninety
days following the adoption of the resolution.
SECTION 4. REPAIR OR REMOVAL OF STRUCTURE
(a) After a hearing before the City Council, the owner
must make such improvements as deemed necessary by
the building inspector, or remove the structure
within ninety days from the date a decision is
made by the City Council regarding the structure.
However, should a structure be deemed a hazard
to the health, safety, and welfare to either
residents of the structure or adjoining property
owners all improvements or removal of the structure
must be immediately undertaken and completed within
five days from a City Council decision. If after
ninety days the owner has not made the necessary
repairs or removed the structure the Building
Official shall cause the repairs or removal..
and expenses incurred shall be charged against
the owner of the property and shall be a lien
on the lot and premises.
SECTION 5. LIEN
(a) Any officer abating a nuisance under the provisions
of this ordinance shall forward to the City Attorney
a written statement of any expenditures made from
city funds in connection therewith, and it shall be
the duty of the City Attorney to proceed without
delay to foreclose such lien or otherwise compel
the owner of such premises to repay the amount
thereof to the City, together with all charges of
collection.

Sec. 10. Penalty for
altering or tampering with
Code.
Any person, firm, or
corporation who alters,
changes, or amends the
Code of Ordinances
adopted by this ordinance
except in the manner
prescribed by this or-
dinance, or who alters or
tampers with the Code in
any manner so as to cause
the ordinances of the City
to be misrepresented
thereby, is guilty of a
misdemeanor, and upon
conviction thereof, shall be
fined not more than Two
Hundred Dollars ($200.00).
Sec. 13. Date of effect.
This ordinance and the
Code of Ordinances
adopted by it shall take
effect and be in full force
