O77-10CITY OF KENNEDALE ORDINANCE NO. 77-10 AN ORDINANCE EXEMPTING $4,000.00 OF THE ASSESSED VALUE OF RESIDENT HOMESTEADS OF PERSONS SIXTY-FIVE YEARS OF AGE OR OLDER FROM THE CITY OF KENNEDALE AD VALOREM TAXES WHEREAS, by amendment to the Texas Constitution at an election held for that purpose, the voters of the State of Texas have authorized the governing body of municipalities to exempt not less than $3,000.00 of the assessed value of resident homesteads of married or unmarried persons sixty-five years of age or older from ad valorem taxes there- after levied by the municipality; and WHEREAS, the City Council of the City of Kennedale, Texas, ' has heretofore granted such exemption to the extent of $3,000.00 of assessed value, and now desires to increase such exemption to $4,000.00 of assessed value of such homesteads; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That pursuant to Article VIII, Section 1 - b, of the Texas Constitution, $4,000.00 of the assessed value of resident home- steads of persons sixty-five years of age or older, shall be exempt from City of Kennedale ad valorem taxes when taxes are levied for the year 1977, and all subsequent levies, as approved by this City Council, upon the owner's compliance with the following: (a) That the resident owner of the homestead shall be sixty-five years of age or older as of January 1 of the tax year. (b) That the resident owner of the homestead be an actual occupant of the homestead on which the exemption is sought or claimed. (c) That the resident owner of the homestead shall submit to the Tax Assessor -Collector for the City of Kennedale before June 30, 1977, and before each April 30 of subsequent years, an affidavit that the person is sixty- five years of age or older and is owner and occupant of the property for which exemption is sought. (d) Any other lawful requirements as may be included in the tax levy ordinance. 2. That any person who makes a false affidavit in claiming a,homestead exemption under this ordinance shall be subject to all interest charges and penalties which accrue for lack of payment of taxes for which exemption is thereby given, and any other appropriate criminal penalties. 3. That this ordinance shall take effect immediately from and after its passage and approval. ADOPTED AND APPROVED this l2th day of May, 1977.
