AN ORDINANCE AMENDING THE KENNEDALE BUILDING
CODE (KENNEDALE ORDINANCE NO. 73-3), AND IN
PARTICULAR SEC. 302(a) OF THE UNIFORM BUILDING
CODE ADOPTED BY SAID ORDINANCE, TO PROVIDE THAT
CERTAIN APPLICATIONS FOR BUILDING PERMITS IN
ZONING DISTRICT "C" AND LESS RESTRICTIVE ZONING
DISTRICTS SHALL BE REFERRED TO THE PLANNING AND
ZONING COMMISSION FOR CLEARANCE BEFORE ISSUANCE
OF A BUILDING PERMIT, AND PRESCRIBING RULES
RELATING THERETO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. The Kennedale Building Code (Kennedale Ordinance
No. 73.3) is hereby amended by amendment of Sec. 302(a) of the
Uniform Building Code therein adopted, and identified as UBC, in
the following particulars only.
2. Said Sec. 302(a) of UBC is hereby amended by the
insertion of the following paragraph, to be the second unnumbered
paragraph appearing in Sec. 302(a) and to read as follows:
"All applications for building peLmits in Zoning District
"C" or less restrictive zoning districts under the provisions of the
Kennedale Zoning Ordinance - that is, in Zoning Districts "C", "D",
"E", "F", and "G" - for construction of a new building, or for addition
to or alteration of an existing building at an estimated construction
cost exceeding $2,000.00, shall be referred by the Building Official,
together with the plans and specifications filed therewith, to the
Kennedale Planning and Zoning Commission to determine whether the
plans are in compliance with the Zoning Ordinance, both with respect
to building plans and location and contemplated use, such referral
to be prior to the issuance of any building petuiit on such applications.
If the said Planning and Zoning Commission finds the application and
contemplated use to be in compliance with the Zoning Ordinance, it
shall return the application to the Building Official with its approval,
and the Building Official will then make his determination in accordance
with other provisions of this Section. The Building Official shall
not issue any such building petmit in the aforesaid Zoning Districts
without the prior approval of the Planning and Zoning Commission. If
said Commission finds the plans and contemplated use are not in
compliance with the Zoning Ordinance, it shall reject the application
and so inform the Building Official.
3. Except as herein amended, said Kennedale Building
Code is expressly ratified and continued in full force and effect
as originally adopted and heretofore amended.
4. This Ordinance shall be in full force and effect
immediately upon its adoption and approval.

CITY OF KENNEDALE ORDINANCE NO. 74-5
AMENDMENT OF KENNEDALE BUILDING CODE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS:
1. That the Kennedale Building Code, being Kennedale
Ordinance No. 73-3, as originally adopted on March 8, 1973,
be and the same is hereby amended as set forth in this ordi-
nance.
2. Section 7 thereof, pertaining to amendments to
Sec. 303(a) of the Uniform Building Code, is hereby amended
in the following respects only:
(a) Under Subsection (a) of said Section 303,
Determination of Basis For Construction Costs,
the Building Use Item 4, entitled "Miscellaneous",
and referring to swimming pools and fences, is
deleted in its entirety. It is the intention of
the City Council that these items will not be a
part of estimated construction costs in determin-
ing permit fees, but will be covered under other
permit fees in Subsection (f) of the amendments
to said Section 303.
(b) Under Subsection (b) of said Section 303,
Building Permit Inspection Fees, the first two
categories for fee in relation to estimated con-
struction cost shall be amended to read as follows:
"CONSTRUCTION COST: FEE:
$0 to $250 No Charge
$251 to $1,000 $2.00 ".
(c) Under Subsection (c) of said Section 303,
Moving Permit Fees, the following provision is
added as Item 5 thereof:
"5. No permit to move a house or building shall be
issued hereunder in violation of the provisions of
Kennedale Ordinance No. 72-9, adopted on August 10,
1972."
(d) Under Subsection (f) of said Section 303, Per-
mit Fees - Other, the reference to Sidewalk or Curb
Construction as the last itemzation thereunder is
deleted in its present form, and the following items
are added thereto:
"Swimming Pool - each . . . $10.00 fee;
Fence, Sidewalk or Curb*
•
No fee.*
(*Provided, however, saidinstallations shall be
subject to City inspection and approval, with-
out charge therefor, as to conformity to the
neighborhood and good construction standards.)"
(e) Subsection (g) of said Section 303, Inspection
Fees - Modular or Pre -fabricated Buildings, is deleted
in its entirety. It is the intention of the City
Council that permits shall not be issued for this type
of construction under this ordinance, except as same
complies with other standards in the Building Code
and other applicable ordinances of the City, in which
event other provisions relating to permit and fees
therefor will apply.
3. Section 8 thereof is hereby amended by addition there-
to of the following sentence: "In ascertaining provisions that
may be in conflict with this ordinance, and hereby repealed,
reference must also be made to the Uniform Building Code, adopt-
ed by reference in Section 2 hereof, as well as the wording of
this Ordinance No. 73-3 itself."
4. Except as hereby expressly amended, the said Kennedale
Building Code (Ordinance No. 73-3) is continued in full force and
effect as originally adopted.
