O76-03CITY OF KENNEDALE ORDINANCE NO. ' AN ORDINANCE AMENDING THE CITY OF KENNEDALE ZONING ORDINANCE, BEING CITY OF KENNEDALE ORDINANCE NO. 69-5, AS HEREINAFTER SET FORTH; SAID AMENDMENTS RELATING TO MINIMUM LOT SIZES, MINIMUM YARD AND OPEN SPACE REQUIRE- MENTS, AND MINIMUM LIVEABLE FLOOR SPACE REQUIREMENTS IN VARIOUS ZONING DISTRICTS. WHEREAS, after due notice and public hearings as required by law, both the Zoning Commission and the City Council of the City of Kennedale, Texas, have considered the amendment of the Kennedale Zoning Ordinance (City of Kennedale Ordinance No. 69-5) in the particulars hereinafter set forth; and WHEREAS, the Kennedale Zoning Commission has recommended the adoption of such amendments; and WHEREAS, the City Council of the City of Kennedale, Texas, is of the opinion that the following amendments to said Kennedale Zoning Ordinance will promote the purposes of said Zoning Ordinance and the health, safety and general welfare of the residents of said City; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the Kennedale Zoning Ordinance, being City of Kennedale Ordinance No. 69-5, as originally adopted and heretofore amended, be and the same is hereafter amended in the following particulars only: (a) SECTION 5A - "A" ONE FAMILY DISTRICT, SUBDIVISION B. HEIGHT AND AREA REGULATIONS thereof, is amended as follows: (la) Minimum liveable floor space of the main dwelling in Subparagraphy1 thereunder is increased to 1,250 square feet. (2a) Minimum lot area in Subparagraph 7 there- under, is increased to 8,750 square feet. (3a) Added as Subparagraph 8 thereunder, is the following: "Length or Depth of Lot: The length of a lot, or its depth from the street frontage, shall be a minimum of 125 feet, provided that where a lot of record and in separate ownership at time of the passage of this amendment has less length or depth than herein required, this regulation shall not prohibit erection of a one family dwelling if other requirements of the ordinance are met." (b) SECTION 5B - "B" MULTIPLE FAMILY DISTRICT, SUBDIVISION B. HEIGHT AND AREA REGULATIONS thereof, is amended as follows: (la) Minimum liveable floor space of the main dwelling in Subparagraph 1 thereunder is increased to 1600 square feet for a two- family dwelling, and 800 square feet per family unit for three-family and four -family dwellings; provided if a single-family dwell- ing is erected in such district, the minimum liveable floor space shall be 1250 square feet. (2a) Maximum rear yard depth that need not be exceeded in Subparagraph 4 thereunder is decreased to 20 feet. ing spaces required to two spaces per family unit for two-family, three-family and other multiple dwellings, including apartment houses, under Sub- paragraphs (b) and (c) thereof, with such require- ments as to single-family dwellings under Subpara- graph (a), boarding and lodging houses under Sub- paragraph (d) and hotels under Subparagraph (e) to remain the same as heretofore provided. (e) SECTION 6 - SUPPLEMENTARY DISTRICT REGULATIONS is hereby amended by adding thereto the following as the last unnumbered paragraph thereunder: "Safety Requirements: In all dwellings containing two or more family units, regardless of the district in which erected, at least two means of exit for each family unit shall be provided, and approved and commercially available smoke detectors shall be installed in each family unit dwelling area." 2. Except as herein expressly amended, the said Kennedale Zoning Ordinance (Kennedale Ordinance No. 69-5) shall remain in full force and effect as heretofore adopted and amended, and the herein contained amendments shall be construed as to supplement and comple- ment other existing provisions of said Zoning Ordinance except to the extent of irreconcilable conflict, in which event these amend- ments shall be construed as repealing the conflicting provisions only. 3. These amendments shall be in full force and effect immediately upon their adoption.
