O75-10CITY OF KENNEDALE ORDINANCE NO. 75-10 AN ORDINANCE PRESCRIBING RATES TO BE CHARGED BY, AND REGULATIONS CONCERNING USAGE OF THE KENNEDALE MUNICIPAL WATER SYSTEM, AND AMENDING AND REPEALING ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. Water Consumption Charges. (a) Each meter connection shall be charged the following rates for water consumption per month: 0 to 2,500 gallons per month - $3. 2,501 to 4,500 gallons per month - 4,501 to 45 5GO gallons per month gallons; i'° ' 4-5 ;51 to above gallons per month gallons. (b) Each living unit in a multiple dwelling, if served by a common meter, including mobile home parks, shall be charged $3.50 for 0-2,500 gallons of water per month. The balance of the meter reading, if any, after the 2,500 gallons per living unit is deducted, shall be divided equally among the number of living units, and each living unit shall be charged at the same rate as a single family residence using more than 2,500 gallons. (c) In the event that a water meter fails to register during any period, the customer shall be charged for that period on an estimate made by the city secretary based upon the average bill for the preceding three (3) months that the meter was registering properly, or from other information available which would provide a more equitable basis for the charge. (d) All bills for city utilities rendered by the City of Kennedale, shall be paid monthly by the 10th day of the month after the billing date. If such bills are not paid by the 20th day of said month, a 10 per cent penalty will be added for late payment. If said bill is not paid by the 15th of the following month, the service shall be discontinued, and water and sewer services are indivisible in this regard, so that non-payment for either service will justify discontinuance for both services. (e) There shall be no water connection outside the corporate limits of the city of Kennedale.. For such services presently connected a charge shall be assessed as follows per month: Minimum rate - $5.00 per month; Each thousand gallons over the minimum - $.90 per month. 50 (minimum charge) ; $.60 per thousand gallons; - $.50 per thousand - $.40 per thousand Section 2. Other Pertinent Charges of City Utilities. (a) The minimum monthly charge for utility services, including water, shall be applicable as a minimum charge for the furnishing of such service for any part of a calendar month, regardless of the number of days of the month during which service is furnished for less than a whole month. (b) In event of discontinuance of service for non-payment of water or sewer bill, a $5.00 charge will be made for re -connection. (c) For cutting off of water service for problems on the service side of the meter a charge of $2.00 will be assessed. (d) Applications for water service must be made in writing on a form provided by the City Secretary before service will be provided. This application shall constitute a contract on the part of the person making the application. A deposit shall be paid before service is begun, at the following rate: 3/4 inch meter or smaller - $20.00; 1 inch meter - $30.00; 12 inch meter - $35.00; 2 inch meter - $50.00. (e) This deposit will be an ongoing deposit and will only be used should the deposit not cover the charges against that service connection. Such deposit shall be carried in a special city fund; and unless applied to water, sewer, or garbage bill, shall be refunded by the City Secretary when service is terminated. Refund will be made following the immediate next 1st of the month billing date after termination. Section 3. Usage of the Water System. (a) Placement and connection to the city water main may only be made by city employees. Charges for setting are: 3/4 inch meter 1 inch meter - 12 inch meter 2 inch meter - or smaller $145.00; - $325.00; $450.00. - $75.00; Larger meters or compound meter installation will be based on labor and meter costs as determined by City Administrator. (b) All water meters and services connected to the city water system shall remain in place where set, unless re- moval be deemed necessary by the City Administrator if the premises become abandoned. (c) Every building that is capable of independent ownership shall have its own separate water service line and meter connected directly to the city main. Apartment houses, office complexes, mobile home parks, or other buildings as deemed reasonable by the City Administrator may be served by a single meter, provided a service stop is provided for each unit or portion of the entire complex. In such cases the amount of required dposit shall be determined by the City AdMinistrator reasonably commensurate .with the volume of monthly: service. (d) Each service installation shall have, between the meter and service hydrant, a stop and waste valve for the customers' use in making repairs on the customers' property. Present services shall conform to this section when any service is changed or altered. City water system employees shall have the right, at a reasonable time, to read, inspect, remove or test any water meter, and temporarily disconnect the water service for such purpose. (e) If the accuracy or correctness of the water meter is questioned by the customer the meter can be tested. The meter may be tested with the customer present if desired. If a mistake is present, the excess amount, as taken from the total of gallons used, shall be credited to the customers' account. If no error is found in the meter registry, a charge of $2.00 will be made for the test for 3/4 inch meters and actual costs as charged by independent testing company for larger meters. (f) In a shortage of water emergency it shall be the duty of the City Administrator to give reasonable notice to water customers not to use water from the system for any purpose other than domestic use and other uses as determined. Until the City Administrator proclaims the emergency at an end, it shall be unlawful for any person to use water from the city water system for watering or sprinkling a lawn, flower bed, garden, or to use such water for any purpose other than domestic use or designated uses. (g) No person unauthorized by the city may turn off, turn on, connect, disconnect, test, repair, tamper, interfere with, or alter in any manner the Water System of the City of Kennedale. Penalty for such a violation is up to a $200 fine. Section 4. Penalty. (a) Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than $10.00 nor more than $200.00, and each day that any violation continues shall constitute a separate and distinct offense; provided, however, the failure to pay water consumption and other service charges hereunder shall not constitute a penal offense, but such charges shall be a debt of the person, firm or corporation incurring same. (b) Every section of this ordinance, and every provision of each section is hereby declared to be an individual section or provision and the holding of any section or provision of any section to be void, ineffective or unconstitutional for any cause whatsoever shall not be deemed to affect any other section or provision hereof. Section 5. Repealing Clause. This ordinance amends all prior ordinances of the city regulating rates for water service by the Kennedale Municipal Water System, and repeals all ordinances or parts of ordinances of the City of Kennedale to the extent of any necessary conflict with the provisions hereof. This ordinance expressly amends and/or repeals the following numbered ordinances: Ordinance Nos. 16, 19, 21, 22, 69-10, 69-11, 70-5, 71-4 and 75-1. Section 6. Effective Date. This ordinance shall be effective as to ratesherein described for water service rendered on and after January 1, 1976, and shall be reflected in billings therefor made on and after February 1, 1976. The regulatory and penal provisions hereof shall be immediately effective upon adoption of the ordinance, and publication as provided by law. PASSED AND APPROVED this llth day of December, 1975. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the water rates per month to be .charged and -col- lected by the City of Kennedale, Texas, from all customers obtain- ing service from the Waterworks System of the City, shall be and are hereby fixed -as set forth below: Minimum (2,500 gallons per mo.) - - - - $3.50 Next 2,000 gallons, per 1,000 gls.- - - 0.60 4,500 to 50,000 gallons, per 1,000 gis.- 0.50 50,000 100,000 gallons, per 1,000g1s.- 0.30 Over 100,000 gallons, per 1,000 gis. - - 0.25 2. That all bills for services rendered by said System shall be paid monthly by the loth day of the month after the billing date. Tapping fees and meter deposits shall be in accord- ancd with other applicable ordinances of the City of Kennedale. 4. The City shall provide a wye in the alley or street adjacent to the last or nearest corner of the connector's prop- erty, within ten (10) feet of the surface of the ground. The house connection from the City lateral shall be installed at the expense of the connector in accordance withthe regulations of and subject to the inspection of the City. 5. This ordinance shall take effect immediately upon its passage at this meeting, and all ordinances or parts of ord- inances necessarily in conflict herewith are hereby repealed, but only to the extent of such conflict; otherwise, this ordi- nance is to be construed in harmony with other existing ordi- nances of the City and the charges herein provided are intended to be in addition to any charges for services provided by other ordinances and not necessarily in conflict herewith.
