LEGAL NOTICE
CITY OF KENNEDALE ORDINANCE NO. 74-2
AN ORDINANCE REGULATING THE SPEED OF VEHICLES UPON ALL
PUBLIC ROADS AND PUBLIC AREAS WITHIN THE CITY OF KENNEDALE,
TEXAS, SAVE AND EXCEPT. UPON U.S. HIGHWAY 287 WHICH SHALL
CONTINUE TO BE REGULATED BY A PRE-EXISTING ORDINANCE OF
THE CITY; PROVIDING A PENALTY FOR THE VIOLATION OF THI.
ORDINANCE BY FINE NOT TO EXCEED $200.00; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND SETTING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE,
TEXAS:
1. It shall be unlawful for any person to drive or operate a vehicle
on a street or highway within the corporate limits of the City of
Kennedale, Texas, at a speed greater than is reasonable and prudent
under the circumstances then existing. -
2. It shall be unlawful for any person to drive or operate a vehicle
at such a slow speed on any street or highway within the corporate
limits of the City of Kennedale, Texas. as to impede the normal and
reasonable movement of traffic except when reduced speed is
necessary for safe operation or in compliance with law.
3. Any speed is lawful which is less than the prima facie
maximum reasonable and prudent speed for the location, but any
speed in excess of such maximum shall be prima facie evidence that.
the speed is not reasonable or prudent and that it is unlawful,
provided:
(a) That a slower speed is required for compliance with
Paragraps (b) and (c) of Section 166 of Article 6701d, Texas Revised
Civil Statutes (being the Texas Uniform Act Regulating Traffic on
Highways), where there exists a hazard named therein.
(b) That one or more appropriate signs giving notice must be
erected for any location for which the prima facie maximum
reasonable and prudent speed specified by Section 166 of said
Article 6701d, Texas Revised Civil Statues, has been superseded by a
prima facie maximum reasonable and prudent speed established by
the City Council of the City of Kennedale, or other governmental
body, as provided by said Article 6701d.
4. Where no prima facie maximum reasonable and prudent speed
requiring the erection ofa sign or signs giving notice has- been
established for a public street or highway within the City of
Kennedale urban district, the prima facie maximum reasonable and
prudent speed for said location shall be thirty (30) miles per hour as
specified by Section 166 of Article 6701d, Texas Revised Civil
Statutes (Texas Uniform Act Regulating Traffic on Highways),
provided, however, that asiower speed is required by Paragraphs (b)
and (c) of said Section 166, Article 6701d, where there exists a
special hazard named therein.
5. The prima facie maximum reasonable and prudent speed is
hereby determined, declared and established as follows, on the basis
of engineering and traffic investigation, upon the following
designated streets within the corporate limits of the City of
Kennedale, Texas respectively:
(a) Thirty-five (35) miles per hour on Kennedale Little School
Road and Dick Price Road.
(b) Fifteen (15) miles per hour on Harrison Lane, Shady Oaks
Drive, Arthur Court, Bowles Court, Misteltoe Drive, Magnolia Drive,
Paula Lane, Timberline Drive, Crestview Drive, Clover Lone Drive,
Briarwood Drive, Shady Lane and Peggy Lane.
(c) Thirty (30) miles per hour upon all other public streets within
the corporate limits of the City of Kennedale, Texas, save and except
U.S. Highway 287.
6. Prima facie maximum and prudent speed upon U.S. Highway
287 within the corporate limits of the City of Kennedale, Texas, is not
regulated by this ordinance, but shall be as specified in City of
Kennedale Ordinance No. 72-7 as the same now exists or shall be
hereafter amended.
7. Any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor, and upon conviction thereof,
shall be fined in any sum not more than $200.00.
8. All ordinances or parts of ordinances in conflict with the
provision of this ordinance are hereby repealed, but only to the
extent of any necessary conflict.
9. This ordinance shall be in full force and effect immediately upon
its passage and publication, as by low provided.
