O74-01ACITY OF KENNEDALE ORDINANCE NO. 74-1A AN ORDINANCE EXEMPTING $3,000.00 OF THE ASSESSED VALUE OF RESIDENT HOMESTEADS OF PERSONS 65 YEARS OF AGE OR OLDER FROM CITY OF KENNEDALE AD VALOREM TAXES WHEREAS, by amendment of the Texas Constitution at an election held for that purpose, the voters of Texas have author- ized the governing body of municipalities to exempt not less than $3,000.00 of the assessed value of resident homesteads of married or unmarried persons 65 years of age or older from ad valorem tax- es thereafter levied by the municipality; and WHEREAS, the City Council of the City of Kennedale, Texas, desires to grant such exemption to the extent of $3,000.00 of as- sessed value; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That pursuant to Article VIII, Sec. 1-b, of the Texas Constitution, $3,000.00 of the assessed value of resident homesteads of persons 65 years of age or older, shall be exempt from City of Kennedale ad valorem taxes when taxes are levied for the year 1974, and all subsequent levies, as approved by this City Council, upon the owner's compliance with the following: (a) That the resident owner of the homestead shall be 65 years of age or older as of January 1 of the tax year. (b) That the resident owner of the homestead shall be an actual occupant of the homestead on which the exemption is sought or claimed. (c) That the resident owner of the homestead shall submit to the Tax Assessor -Collector for the City of Kennedale before April 30, 1974, and before April 30 of subsequent years, an affidavit that the person is 65 years of age or older and is the owner and occupant of the property for which exemp- tion is sought. (d) Any other lawful requirement as may be included in the tax levy ordinance. 2. That any person who makes a false affidavit in claim- ing a homestead exemption under this ordinance shall be subject to all interest charges and penalties which accrue for lack of payment of taxes for which exemption is thereby given, and any other penal- ties appropriate under criminal provisions of the law. 3. That this ordinance shall take effect immediately from and after its passage and approval. ADOPTED AND APPROVED this 14th day of February, 1974. APPROVED: / T.
