KENNEDALE BUILDING CODE
AN ORDINANCE REGULATING THE ERECTION, CON-
STRUCTION, ENLARGEMENT, ALTERATION, REPAIR,
MOVING, REMOVAL, CONVERSION, DEMOLITION,
OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA,
AND MAINTENANCE OF BUILDINGS OR STRUCTURES
IN THE CITY OF KENNEDALE, TEXAS, TO BE
KNOWN AS THE KENNEDALE BUILDING CODE; PRO-
VIDING FOR THE ISSUANCE OF PERMITS AND COL-
LECTION OF FEES THEREFOR; DECLARING AND ES-
TABLISHING FIRE DISTRICTS; PROVIDING PENALTIES
FOR THE VIOLATION THEREOF; AND REPEALING ALL
ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
THEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
Section 1. Designation Of Code.
This ordinance, and all the hereinafter contained provis-
ions, whether expressly set forth in this ordinance or adopted
by reference as a part hereof, is hereby designated as the Ken-
nedale Building Code, which shall constitute the short title of
this ordinance.
Section 2. Adoption Of Code.
There is hereby adopted by reference, as a part of this
ordinance, the same as if set forth verbatim herein, the Uni-
form Building Code, Volume I, 1970 Edition (herein called
"Uniform Building Code" and °`UBCe'), as enacted and published
by the International Conference of Building Officials, togeth-
er with the additions, deletions and amendments hereinafter
contained. Said Uniform Building Code, with such additions,
deletions and amendments, shall constitute the Building Code
of the City of Kennedale, Texas, and this ordinance shall be
known by the short title of Kennedale Building Code. Said
Building Code is adopted for the purpose of regulating the
erection, construction, enlargement, alteration, repair, mov-
ing, removal, conversion, demolition, occupancy, equipment, use,
height, area and maintenance of buildings and structures in the
city of Kennedale, Texas.
A copy of said Uniform Building Code, marked Exhibit A
and signed for identification by the Mayor and City Secretary
and impressed with the City Seal on the inside of the front
cover thereof, shall be kept on file with this original ordin-
ance for the purpose of completing the ordinance and showing
the provisions hereby adopted by reference. However, said
identification shall not be necessary to the validity of this
ordinance, or the adoption by reference of said Uniform Build-
ing Code, and any officially published copy thereof shall con-
stitute a valid reproduction of that portion of the Kennedale
Building Code. Copies of such Uniform Building Code shall be
available for purchase at such price as the City Council shall
designate through the office of the City Secretary, or those
desiring copies may purchase them direct from the publisher.
Section 3. Code Defined; Rule of Construction.
The Kennedale Building Code shall include all of the
provisions of the Uniform Building Code as adopted by Section 2
hereof, and all other provisions of this ordinance. In event
there is determined to be a conflict between any provision of
the Uniform Building Code as adopted by reference and the oth-
er provisions of this ordinance hereinafter provided, the lat-
ter provisions shall be construed as controlling and taking
precedence over the former.
Section 4. Amendments, Additions And Deletions.
The adoption by reference of said Uniform Building Code,
as provided in Section 2 hereof, is made subject to and is modi-
fied and amended as follows:
(a) By the amendment of Section 205 of UBC, pertaining to vio-
lations and penalties, as hereinafter provided in this or-
dinance.
(b) By the amendment of Section 303(a) of UBC, pertaining to
building permit fees, as hereinafter provided in this or-
dinance.
(c) By the deletion in its entirety of Section 303(b) of UBC,
pertaining to plan -checking fees.
(d) By the deletion in its entirety of Section 304(d-3), per-
taining to lath and/or wallboard inspection.
(e) By the deletion in its entirety of Section 1313 of UBC,
pertaining to existing buildings for Group H occupancy.
(f) By the deletion in its entirety of Section 3309(b) of
UBC, pertaining to required smoke -proof enclosures.
(g) By the amendment of Section 503(d)(4) of UBC to read as
follows: "Openings between the garage and residence shall
be equipped with solid wood doors not less than one-3/8
inches in thickness or equivalent. The garage shall be
completely separated from the residence and its attic
area by means of a 1/2" Gypsum Board or equivalent applied
to the garage side.'
(h) By the amendment of Section 2629 of UBC to read as follows:
"The minimum thickness of concrete floor slabs supported
directly on the ground shall be not less than 3-1/2' unless
designed by an architect or engineer. An approved vapor
barrier shall be installed underneath the slab in all resi-
dential occupancies.`'
(i) By the adoption of Appendices as hereinafter provided in
this ordinance.
Section 5. Violations And Penalties.
Section 205 of the UBC is amended to read as follows:
Sec. 205. It shall be unlawful for any person, firm or cor-
poration to erect, construct, enlarge, alter, repair, move, im-
prove, remove, convert or demolish, equip, use, occupy or main-
tain any building or structure in the City of Kennedale, Texas,
or cause the same to be done, contrary to or in violation of any
of the provisions of this Building Code.
Any person, firm or corporation violating any of the pro-
visions of this Building Code shall be deemed guilty of a mis-
demeanor, and each and every day or portion thereof during which

any violation of any of the provisions of this Building Code
is committed, continued or permitted, shall constitue a dis-
tinct and separate offense, and upon conviction of any such
violation, any such person shall be punishable by a fine of
not more than $200.00.
Section 6. Adoption of Appendices.
The following referenced materials and provisions are
adopted as appendices to and hereby made a part of this Build-
ing Code, whether attached hereto or incorporated herein by
reference:
Appendix A. The Uniform Building Code.,tandards for
Volume I, 1970 Edition, of the International Conference of
Building Officials, referred to in Sec. 6002 of UBC, a copy
of which is identified as Appendix A and signed on the inside
for identification similar to UBC as above provided, which
copy shall be and remain onfile in the office of the City
Secretary; provided, however, that the adoption of said Uni-
form Building Code Standards is by reference, and any pub-
lished copy thereof shall constitute a part of this ordinance
irrespective of its availability in the City Office.
Appendix B. The Uniform Mechanical Code, 1970 Edition,
as enacted and published jointly by the International Confer-
ence of Building Officials and the International Association
of Plumbing and Mechanical Officials, the same being Volume II
of the Uniform Building Code, adopted and incorporated herein
by reference to the extent as specifically cited and referred
to in the UBC as adopted by Section 2 of this ordinance. A
copy of said Uniform Mechanical Code marked Appendix B and
signed for identification similar to the above provision with
respect to UBC shall be and remain on file in the office of
the City Secretary; provided, however, that this adoption is
by reference, and any officially published copy of said Uni-
form Mechanical Code shall constitute a part of this ordinance
irrespective of whether available in the City Office.
Appendix C. The Appendix to Volume I of the Uniform Build-
ing Code, herein adopted, save and except Chapter 13 of said Ap-
pendix, which is hereby specifically omitted and deleted. A copy
of said Appendix is part of Exhibit A (UBC) as identified, and
shall be and remain on file in the office of the City Secretary;
provided, however, that said adoption is by reference, and any
published copy of said Appendix to Volume I of UBC shall consti-
tute a part of this ordinance irrespective of whether available
in the City Office.
The foregoing Appendices are hereby adopted by reference,
the same as if set forth verbatim herein, as a part of this or-
dinance, to the extent above mentioned. The City Secretary
shall make copies available through the City Office at such
price as the City Council shall determine, or copies may be
obtained direct from the publishers.
Section 7. Permit Fees.
Sec. 303(a) of said Uniform Building Code is hereby amended
to read as follows:
Sec. 303. Permit and Inspection Fees.
(a) Determination of Basis For Construction Costs: In com-
puting the fees to be charged for permits required by this Building
Code, the costs of construction shall be estimated as follows:

(b) Building Permit Inspection Fees. Any person required to
obtain a building permit by the terms of Section 301(a) of the Uni-
form Building Code or any other applicable ordinance of the City of
Kennedale shall pay as an inspection fee, at the time of application
for said permit, a fee based on such estimated construction cost as
above determined, as follows:

(c) Moving Permit Fees: For A permit to move a house or
building in, through or upon the streets, alleys, or other public
property of the City of Kennedale, or from one location to another
on private property, if otherwise permitted by applicable ordinances,
fees shall be as follows:
1. When the point of destination is within the City and the move is
entirely on private property or is completed in one day:
Buildings of less than 300 square feet . . . $15.00
Buildings of 300 to 599 square feet . . . . 20.00
Buildings of 600 to 800 square feet . . . . 25.00
Buildings of more than 800 square feet . . . . 30.00
2. When a building is moved in sections, the total fee shall be
based upon the total area of the building, plus $10.00 for each
section more than one.
3. When the point of destination is outside the City, the fee shall
be 50% of the fee prescribed in the above two paragraphs.

4. When the move requires more than one day upon the City streets,
alleys or other public property of the City, or more than three
days upon private property within the City, there shall be add-
ed for each additional day or part thereof as amount equal to
50% of the fee required for the first day on public property
or the first three days on private property.
(d) Wrecking Permit Fees: For a permit to wreck, raze
or dismantle a building or structure within the City of Kennedale,
the permit fee shall be as follows:
First 2,500 square feet of area . . $2.00
Each additional 1,000square feet or

(e) Sign Permit Fees: For a permit to erect a sign within

(g) Inspection Fees - Modular or Pre -fabricated Buildings:
For buildings or structures manufactured within or without the
City of Kennedale and placed or erected within the City, construc-
tion costs shall be calculated and permit or inspection fees paid
as provided in sub -paragraphs (a) and (b) above. For buildings or
structures manufactured within the City for shipment or transpor-
tation elsewhere, the inspection for which is made and certified to
as provided in Sec. 305 (c) of this Uniform Building Code, the fee
for such inspection and certification shall be $10.00 per unit.
Section 8. Repeal of Conflicting Ordinances.
This ordinance shall repeal all prior ordinances of the City
of Kennedale in conflict with the provisions hereof, but only to
the extent of such conflict.
Section 9. Effective Date.
This ordinance shall be in full force and effect immediately
upon its passage and publication as by law provided.
