AN ORDINANCE MAKING IT UNLAWFUL TO MOVE ANY OLD
OR USED RESIDENTIAL OR COMMERCIAL BUILDING OR
STRUCTURE FROM ONE LOCATION TO ANOTHER WITHIN
THE CITY OF KENNEDALE, TEXAS, OR FROM WITHOUT
THE CITY OF KENNEDALE INTO THE CORPORATE LIMITS
THEREOF; PRESCRIBING A PENALTY FOR THE VIOLATION
HEREOF AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Kennedale, Texas,
finds from the experience of the City that the difficulties of en-
forcement of building code and permit requirements with respect
to relocation of old and used residential and commercial build-
ings, adn the reluctance of individuals to bring such relocated
building;into compliance therewith, makes it impracticable and
contrary to the health, safety and general welfare of the City
of Kennedale and its inhabitants to permit the relocation of
same for occupancy and use; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
1. That it shall be unlawful for any person, firm or
corporation, to move any old or used residential or commercial
building or structure, as herein defined, from one location to
another within the corporate limits of the City of Kennedale,
Texas, or from outside said City to a location within the cor-
porate limits of the City of Kennedale, Texas, for the purpose
of use and occupancy of such building or structure at a new lo-
cation within the City, and no permit shall henceforth be issued
by the City of Kennedale for such purpose.
2. It shall be unlawful for any person, firm or corpor-
ation to place or maintain, or to permit to be placed or main-
tained upon any .roperty within the corporate limits of the City
of Kennedale, Texas, any old or used residence or commercial
building or other structure, as herein defined, which building
or other structure has been moved or relocated in violation of
the preceding section of this ordinance. Any person, firm or
corporation placing any building or structure on property with-
in the City of Kennedale, Texas in violation hereof shall be
deemed to be continually in violation of this ordinance until
such building or structure is moved therefrom and without the
corporate limits of the City of Kennedale. Any person, firm or
corporation owning or renting or in control of any property on
which a building or structure is placed in violation of the
provisions of this ordinance shall be deemed to be continuously
in violation of the ordinance until such building or structure
is moved from his or its premises and without the corporate
limits of the City of Kennedale.
3. The term 'old or used residential or commercial
building or other structureshall mean any building, structure
or edifice used as a place of Human habitation or a place of
occupancy for business or commercial purposes at any location,
either within or without the corporate limits of the City of
Kennedale, Texas, for any length of time, and as such i.ermis
used in the prohibition of this ordinance, shall forbid the re-
location of such structure anywhere within the corporate limits
of the City of Kennedale, Texas, for the purpose and intent of
thereafter again using such building or structure for human
habitation or for occupancy for business or commercial purposes.
Said term, and the prohibition of this ordinance, shall not ap-
ply to a portable building for temporary use, such as a con-
struction office, and shall not apply to pre -fabricated struc-
tures newly constructed, nor to mobile homes, if their relocation
within or transporting through the City of Kennedale is in con-
formity with other ordinances of the City.
4. All ordinances or parts of ordinances in conflict
with this ordinance are hereby repealed, but only to the extent
of such necessary conflict.
5. Any person, firm or corporation violating the pro-
visions of this ordinance shall be deemed guilty of a misde-
meanor, and upon conviction thereof, shall be fined in any sum
not to exceed $200.00. Each day that a violation of this ordin-
ance continues shall be deemed to constitute a distinct and sep-
arate offense.
6. This ordinance shall be in full force and effect
immediately upon its passage and publication, as by law provided.
