O72-01CITY OF KENNEDALE ORDINANCE NO. 72-1 AN ORDINANCE CALLING AN ELECTION ON THE PROPOSITION OF CONSOLIDATION OF THE CITY, OF KENNEDALE, TEXAS, WITH THE.. CITY OF ARLINGTON, TEXAS. THE STATE OF TEXAS: COUNTY OF_ TARRANT• CITY. OF KENNEDALE; WHEREAS, a petition has been presented to the City Council of. the City of Kennedale, Texas, requesting an elec- tion for the purpose of_voting on the consolidation of the City of Kennedale with the City of Arlington, Texas; and WHEREAS, after due investigation, the City Council of the City of Kennedale, Texas, has determined that said petition is signed by qualified voters of the City of Ken- nedale greater in number than fifteen (15%) per cent of the total vote cast at the last preceding election for city of- ficials of the City of Kennedale; and WHEREAS, it is the statutory duty of this City Coun- cil to call an election upon such question; now, therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That an election shall be held on the ay of , 1972, in the City of Kennedale, Texas, at the Kennedale ty Hall, which shall be the only polling place, and said City of Kennedale shall constitute a single election precinct for said election, and the following elec- tion officers are hereby appointed to hold said election: Ida Flake, Presiding Judge; and Nettie Vick, Alternate Pre- siding Judge. 2. That the Presiding Judge shall appoint not less than two (2) qualified Election _Clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such Clerks. 3. That by approving and signing this ordinance, the Mayor of the City of Kennedale officially confirms his appointment of the aforesaid election officers to serve at said election, and by passing this ordinance the City Coun- cil of the City of Kennedale approves and concurs in the ap- pointment of the aforesaid election officers. 4. That said election is called for the purpose of voting upon the question of consolidation of the City of Kennedale, Texas, with the City of Arlington, Texas, and theballots for said election shall have printed thereon at the top the following proposition: "PROPOSITION: Shall The City Of Kennedale Texas, Be Consolidated With The City Of Arlington, Texas?"; and shall have printed beneath such propo- sition the words •'.'For Consolidation', and .the words "Against Consolidation", with the usual instructions concerning the manner of voting. 5. That said election is to be held in accordance with the provisions of Articles 1188-1191, As Amended, Texas Revised Civil Statutes, and consolidation shall mean, if such proposition is favorably approved at elections in bath the City of Kennedale and the City of Arlington, that the City of Kennedale, as the smaller city,,will thereby adopt the charter and ordinances and name of the City of Arlington, as the larger city, and will thereby be included within the territory of Arlington, and that the area of the City of Kennedale shall become subject to all the laws and regu- lations of the City of Arlington, as provided by law. 6. That notice of said election shall be given by posting a substantial copy of this ordinance at the Kennedale City Hall and at two other places in the City of Kennedale, Texas, not less thanthirty days prior to the date set for said election, and by publishing a substantial copy of this ordinance on the same day in each of two successive weeks in the Kennedale News, a newspaper of general circulation pub- lished in the City of Kennedale, the date of the first pub- lication to be not more than twenty-five days nor less than fourteen days prior to the date set for said election. 7. That said election shall be held in accordance with law, and all qualified electors of the City of Kennedale, Texas, shall be entitled to vote at said election, and the votes cast thereat shall be recorded, returned and canvassed in accordance with the law. 8.
