O71-09CITY OF KENNEDALE ORDINANCE NO. 71-9 AN ORDINANCE FORBIDDING THE PLACING OF A MOBILE HOME, AS HEREIN DEFINED, UPON ANY PREMISES IN THE CITY. OF KENNEDALE, TEXAS, FOR RESIDENTIAL OCCUPANCY, EXCEPT IN EXISTING MOBILE HOME PARKS; PROVIDING A PENALTY. FOR THE. VIOLATION HEREOF, AND AN EFFECTIVE DATE. WHEREAS, the Kennedale Zoning Ordinance, being City of Kennedale Ordinance No. 69-5, excludes mobile homes as permis- sible uses upon property in the City of Kennedale, Texas, and said comprehensive zoning ordinance was adopted after extensive study and planning for future development of the City of Kenne- dale, Texas; and WHEREAS, the City Council of the City of Kennedale deems it detrimental to property values in the City andto the orderly development of the City of Kennedale as designed by comprehen- sive planning for mobile homes to continue to be placed at random on property throughout the city of Kennedale; and WHEREAS, the said City Council has been continuously plagued with repeated requests, at almost every meeting of said City Council, for permission to place mobile homes upon premises in Kennedale as exceptions to the Kennedale Zoning Ordinance, to the point that such requests have taken an inordinate amount of the time ofsaid City Council and have disrupted the orderly handling of other city business; and WHEREAS, there are existing in the City of Kennedale several mobile home parks which were operating prior to the en- actment of the comprehensive amendment of the Kennedale Zoning Ordinance (City of Kennedale Ordinance No. 69-5), which mobile home parksarepermissively continuing in operation as legal non -conforming uses of property under said Kennedale Zoning Or- dinance; and WHEREAS, the City Council of the City of Kennedale, Texas, deems thepresently existing mobile home parks within the City of Kennedale adequate for mobile home residential housing within the present corporate limits of said City of Kennedale, Texas; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. The term "mobile home" as used in this ordinance shall mean a detached residential dwelling unit designed for transporta- tion after fabrication on streets or highways on its own wheels or on flat bed or other trailers, and arriving at the site where it is to be occupied as a dwelling complete and ready for occupancy except for minor and incidental unpacking and assembly operations, location on jacks or other temporary or permanent foundations, connections to utilities, and the like. 2. It shall hereafter be unlawful for any person, firm or corporation to place anymobile home, as herein defined, upon any premises or property in the city of Kennedale, Texas, for residential occupancy, save and except within the boundaries and premises of presently existing mobile home parks within the City of Kennedale, Texas, which existing mobile home parks are in oper- ation as a legal non -conforming use under the Kennedale Zoning Ordinance (City of Kennedale Ordinance No. 69-5) at the time of adoption of this ordinance. 3. It shall be unlawful for any person, firm or corpora- tion to occupy any mobile home, as herein defined, or permit the occupancy of any such mobile home, as a residence within the City of Kennedale, Texas, which mobile home has been placed on any property within the City of Kennedale, Texas, subsequent to the date of passage of this ordinance and in violation of the provis- ions of the preceding paragraph of this ordinance. 4. Any person, firm or corporation violating the provis- ions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any stern not to exceed $200.00. Each day that a violation of this ordinance continues shall be deep ed to constitute a distinct and separate offense, and each day that a mobile home is maintained upon any property in the City of Kennedale in violation of the provisions of this ordinance shall therefore be deemed to constitute a separate offense.
