O71-05CITY OF KFNNEDALF ORDINANCE NO. 71-5 AN ORDINANCE PROHIBITING THE OPERATION OF MOBILE SERVICE UNITS, AS DEFINED IN ARTICLE SEC, 9(d), VERNON'S TEXAS PENAL CODE, TATTTHTN-TH7 CORP- ORATE LIMITS OF THE CITY OF KENNEDALE, TEXAS: PRO- VIDING A PENALTY FOR THE VIOLATION HEREOF, AND AN EFFECTIVE DATE. WHEREAS, by virtue of Chapter 226, Acts of the 62nd Legislature, 1971, Regular Session (Art. 1111c-1, Sec 2(d), Vernon's Texas Penal Code), the Texas Legislature has dele- gated to the State Board of Insurance the duty to provide rules and regulations for movement and operation of mobile service units, expressly reserving to municipalities the right to pro- hibit mobile service units within their boundaries; and WHEREAS, in said statute, mobile service units are defined as vehicles, tank trucks or other mobile devices fro which flammable liquids, used as motor fuels may, as an act of retail sale, be dispensed into the fuel tanks of motor ve- hicles parked on off-street parking facilities; and WHEREAS, the City Council of the City of Kennedale, Texas, deems it to be in the best interest of the public safe- ty and welfare of citizens and inhabitants to orohibil- the operation of such mobile service units within the corporate boundaries of said City; now, therefore: RE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENN7DALE, TEXAS: It shall be unlawful for any person, firm or corp- oration to operate any mobile service unit, as defined in the ,sforesaid. statute (Art. 1111c-1, Sec, (d), Vernon's Texas Pena w;thi„, limits of q-h.
