O71-10CITY OF KENNEDALE, TEXAS ORDINANCE CALLING AN ELECTION ORDINANCE NO. 71-10 THE STATE OF TEXAS COUNTY OF TARRANT CITY OF KENNEDALE WHEREAS, it is deemed necessary and advisable to call the election hereinafter ordered; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which re- quires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds from the sale of the proposed bonds are required as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting was. open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St. Article 6252-17. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE: 1. That an election shall be held on November 20, 1971, in said City at the following designated polling place: CITY HALL, KENNEDALE, TEXAS. Said. City shall constitute a single election precinct for said election, and the following election officers are hereby appoint- ed to hold said election: Presiding Judge: Ida Flake Alternate Presiding Judge: Nettie Vick 2, That the Presiding Judge shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one. of such clerks. 3. That by approving and signing this Ordinance the Mayor of said City officially confirms his appointment of the aforesaid election officers to serve at said election; and by passing this Ordinance the governing body of said City approves and concurs in the appointment of the aforesaid election officers. 4. That said election shall be held and conducted in effect as two separate but simultaneous elections, to -wit: one election at which only the resident, qualified electors who own taxable property in the City and who have duly rendered the same for tax- ation shall be entitled to vote, and another election at which all other resident, qualified electors of the City shall be en- titled to vote. The votes cast at each of said separate but simultaneous elections shall'be recorded, returned, and canvass- ed separately. It is hereby declared that the purpose of holding the election in such manner is to ascertain arithmetically, with respect to a submitted PROPOSITION, (a) the aggregate votes cast at the election for and against the PROPOSITION by resident, qualified electors of the City, and also (b) the aggregate votes cast at the election for and against the PROPOSITION by resident, qualified electors who own taxable property in the City and who have duly rendered the same for taxation. Each elector shall be entitled to vote once, in accordance with the provisions of this Ordinance. 5. That notice of said election shall be given by posting a substantial copy of this Ordinance at the City Hall and at two other places in said City, not less than 15 days prior to the date set for said election; and a substantial copy of this Ordinance also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, the date o.f the first publication to be not less than 14 days prior to the date set for said election. 6. That at said election the following PROPOSITIONS shall be submitted in accordance with law: PROPOSITION NO. 1 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $300,000.00,- for the purpose of improving and extending the Sewer System of said City, with the bonds. of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and with said bonds to bear interest, and be issued and sold in accordance with law; and shall said' City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 2 Shall the City Council of .said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $200,000.00, for the purpose of improving and extending the Sewer System of said City, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and with said bonds to bear interest, and be issued and sold in accordance with law; and with said bonds to be secured by and payable from a lien on and pledge of the Net Revenues of said City's Waterworks and Sewer System? PROPOSITION NO. 3 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $200,000.00, for the purpose of improving and extending the Waterworks System of said City, with the bonds of each such series or issue, respectively, to mature serially within not to exceed forty years from their date, and with said bonds to bear interest, and be issued and sold in accordance with law; and shall said City Council be authorized to levy and cause to be assessed and collected annL1al ad valorem taxes iri an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? The rapid growth of the City has created new demands on our water and sewer systems. Your Council has made a comprehensive study and has determined that essential improvements should be made during the next five years. In order to implement these improvements a bond election has been called for November 20. A summary of the issues to be considered by the voters is as follows: Sewer System - Less than half of the citizens are provided with sewerage facilities. Some 400 septic tanks are in operation with probably 200 of these overflowing. These overflowing septic tanks are health hazards for the entire City and need to be eliminated. The State of Texas will require that these pollution hazards be eliminated. Your Council believes that the City should stop these pollution hazards before the State takes any legal action. Elevated Water Tank - The City has been plagued with inadequate elevated water storage for the past several years. The Texas Insurance Commission recommends that a town of our size have elevated storage of at least 160,000 gallons - we now have only 55,000 gallons. Additional storage is necessary to provide adequate water and fire protection and to effect a non -penalty fire insurance rate. Water Distribution System - The growth of the City has created larger demands for water service and new water mains are required to strengthen the system. Some areas are without City water and water lines need to be extended to provide service to all. In order to finance these improvements, a bond election has been called for November 20. The ballot will be divided into four (4) propositions that are as follows: 1. For the issuing of $300,000 Sewer General Obligation Bonds. 2. For the issuing of $200,000 Sewer Revenue Bonds. 3. For the issuing of $200,000 Water General Obligation Bonds. 4. For the issuing of $165,000 Water Revenue Obligation Bonds. We plan to issue approximately $225,000 General Obligation Bonds within the next year with the remainder being issued as finances will permit so as not to create a burdensome tax. This initial financing will not require a tax increase. The Revenue Bonds will be supported from the net earnings of the water and sewer systems and can never be paid from money collected from ad valorem taxes. Studies of our finances indicate that all $365,000 of Revenue Bonds can be issued by 1973 without any rate increases. It is the unanimous opinion of the Council that this is a sound and necessary improvement program. We earnestly request you vote "FOR" on each of the propositions on November 20.
