O70-12KENNEDALE ORDINANCE NO. 70-12 AN ORDINANCE VACATING AND ABANDONING THE ALLEY ACROSS BLOCK 61, OF THE ORIGINAL TOWN OF KENNEDALE, TEXAS, AS SAME APPEARS ON THE PLAT THEREOF ON FILE IN THE DEED RECORDS OF TARRANT COUNTY, TEXAS. WHEREAS, the owners of all the lots in Block 61, of the Original Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant County, Texas, have petitioned the City Council of the City of Kennedale, Texas, to vacate and abandon the alley dedi- cated and shown by said plat across said Block 61, Original Town of Kennedale, Texas; and WHEREAS, the Kennedale City Council, after due hearing and investigation, has found and determined that said alley, al- though dedicated and platted as such many years ago, has never been used or improved as a public alley, but has been continu- ously devoted to private use since its dedication, that no pub- lic benefit will be served by opening and improving such alley across said Block 61 at this time, and that it would be in the public interest that such unused alley be vacated and abandoned, so that same can be developed and improved for private purposes; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the alley across Block 61 of the recorded plat of the Original Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant County, Texas, be, and such alley across said Block 61 of the Original Town of Kennedale, Tarrant County, Texas, is hereby abandoned and vacated as a public alley. 2. That no present need or necessity exists for a public alley across said Block 61, that said alley has never been used as such, but has continuously since its dedication been devoted to private use, and that the public interest will best be served by the vacation and abandoned of such alley a- cross said Block 61 to that said property can be developed and improved for private purposes. 3. That title to the alley hereby vacated and abandoned shall revert to the abutting property owners on each side thereof, so that said abutting owners shall henceforth own to the center of such vacated alley, respectively. Boyd, City Sect tary of the City of Kennedale, Texas (CITY SEAL) PETITION TO VACATE AND CLOSE ALLEY THE STATE OF TEXAS: COUNTY OF TARRANT: ) ) ) WE, the undersigned, being all of the owners of all of the lots in Block 61 of the Original Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant County, Texas, and being the owners of all property that would be thereby affected, hereby petition the City Council of the City of Kennedale, Texas, to vacate, abandon and close the alley as same is platted across said Block 61, Original Town of Kennedale, Tarrant County, Texas, and provide in the ordinance vacating same that title thereto shall revert to the abutting owner on either side of said alley to the center line thereof. In support of this petition, the undersigned urge to said City Council that said alley, although appearing on the plat of the Town of Kennedale, has never been opened and used as an alley, that such alley serves no public convenience or necessity, and that it would be to the public interest and convenience that such unused alley be vacated of record, so that same can be improved and maintained by the adjoining owners.
