O68-01KENNEDALE ORDINANCE NO. 68-1 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS, FORBIDDING THE HAULING OF GARBAGE, TRASH OR REFUSE_ OF ANY KIND UPON ANY PUBLIC STREET IN THE CITY OF KENNEDALE EXCEPT IN CLOSED CONTAINERS OR COVERED TRUCKS; PRO- VIDING A .PENALTY FOR THE VIOLATION OF SAID ORDINANCE, AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. It shall be unlawful for any person, firm or corporation to move or transport any trash, garbage, rubbish, waste or refuse of any character upon any public street in the City of Kennedale, Texas, unless such garbage, trash, rubbish, waste or other refuse shall be transported within a closed container of sufficiently impervious material to prevent the leakage or escape of the contents of said container in any manner. 2. If such garbage, trash, rubbish., waste or other refuse is transported in a truck, trailer or other vehicle, and the bottom and sides of the truck or trailer bed are sufficiently constructed of solid material to pre- vent leakage and escape of the contents, it shall be sufficient for compliance with this ordinance to cover the top of the truck, trailer or other vehicle with any solid material, in- cluding a tarpaulin, of sufficient strength to prevent es- cape:of the contents; and if such trash, rubbish, waste or other refuse consists entirely of dry materials, as dis- tinguished from liquids or semi -liquids, it shall be sufficient compliance with this ordinance to have the top of such truck, trailer or other vehicle covered with any net material having openings notgreater than three - fourths of one inch in any direction and of sufficient strength to prevent breaking of said material or escape of the contents; provided, however, that any such covering shall be securely fastened at the sides of the vehicle to prevent escape of contents in any manner. 3. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in any sum not to exceed $200.00. 4. This ordinance is hereby declared to be cumulative of all other ordinances of the City of Kenne- dale, Texas, regulating the handling of garbage, trash, rubbish, wastes and other refuse, and shall not be deemed to repeal any previous ordinance except to the extent of any necessary and irreconcilable conflict therewith. 5. We are asking every ones cooperation in this matter. We have ordinances that can be inforced to help clean up our city. After January 1st, 1971, your Police Department will start on Highway 287 giving out waming letters, After you receive the warning letter you will have 15 days to get your property clean. Then you are subject to a citation every day you are in violation of said ordinance. GARBAGE REFUSE ORDINANCE NO. 68-1 An ordinance by the City Council of the City of Kennedale, Texas, forbidding the hauling of garbage, trash or refuse of any kind upon any public street in the City of Kennedale, Texas, except in closed containers or covered trucks; covering to be of solid mat- erial, including tarpaulin or a net covering having openings not greater than three -fourths of one inch in any direction, WRECKED CARS ORDINANCE NO, 23 An ordinance regulating the operation of places used or main- tained as junk yards or dumping grounds, or for the wrecking or dissembling of automobiles, trucks, tractors, or machinery of any kind, or of any of the parts thereof, or for the accumulation of rubbish of any discription; penalty for this violation not to exceed $100. 00. MERCHANDISE ON DISPLAY ORDINANCE NO, 63-3 An ordinance regulating the display of goods, wares and mer- chandise for sale outside of a building or structure within the cooperate limits of the City of . Kennedale, Texas; forbidding such display during hours in which the establishment is closed. providing a penalty not to exceed $200, 00. ORDINANCE NO. 57-6 An ordinance in part, forbidding the accumulation of weeds, grass, brush, garbage and trash; declaring such to be a nuisance, Section 4. It shall be unlawful, under any circumstance, to burn any junked or wrecked automobiles, or any part therof, for wrecking or salvage purposes, or for any other reason, in or upon -any premeises within the City of Kennedale; and it shall be un- lawful under any circumstance, to burn any old tires, rubber, feathers, oil, animal carcasses, or any other substance which shall be particularly obnovious by reason of smoke or odor, or burning of which may endanger the public health or safety. In violation of this ordinance the penalty is not to exceed $200. 00. Section 7. It shall be unrawfui for any person or his agent, owning, renting or having under his control, any lot or premises whether vacant or improved to permit any down timber, brush, old logs, or decaying vegetables so that such weeds or grass or other matter may by reason of fire endanger any adjoining property, and the accumulation of any such timber, brush, grass, weeds or trash on any premises, shall be deemed a nuisance and the pen- alty in violation of this ordinance not to exceed $200, 00.
