O65-20100667•-../ (Th KENNEDALE ORDINANCE NO. 65-20 AN ORDINANCE OF THE CITY OF KENNEDALE, TEXAS, VACATING AND ABANDONING A PLATTED UTILITY EASEMENT ACROSS LOTS 1 AND 2, OF BLOCK 1, WOODLEA ACRES ADDITION, SAID VACATED EASE- MENT ABUTTING THE COMMON BOUNDARY LINE OF LOTS 1 AND 2. WHEREAS, H. J. Taylor is the owner of the northwest 27.5 feet of Lot 1, and the southeast 42.5 feet of Lot 2, Woodlea Acres Addition to the City of Kennedale, Tarrant County, Texas, as said tract is described in deed recorded in Volume 2814, page 215, Deed Records of Tarrant County, Texas, and has made application to the City of Kennedale for the vacation of a platted utility easement abutting the common boundary lines of said Lots 1 and 2; and WHEREAS, there is platted on the plat of Woodlea Acres Addition, recorded in Volume 388-A, Page 130, Deed Records of Tarrant County,Texas, a four foot utility easement along the southeast boundary line of said Lot 2, and a four foot utility easement along the northwest boundary line of said Lot 1, Block 1, Woodlea Acres Addition; and WHEREAS, the City Council of the City of Kennedale, Texas, has found and determined, after investi- gation and hearing, that the said above described platted utility easement, being eight feet in width along the common boundary line of said Lots 1 and 2, Block 1, Woodlea Acres Addition, has never been used as a public utility easement, that a frame residence has been aonstructed and situated across said platted utility easement for a number of years, that there is no necessity for the continuation of said utility easement and no publicpurpose would be served by its continuation, and that said utility easement has been for all practical purposes abandoned, and that it would be to the best interest of the City of Kennedale, its citizens and inhabitants, as well as the owners of said property, that same be vacated and abandoned of record; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the utility easement shown of record across Lots 1 and 2, Block 1, Woodlea Acres Addition to the City of Kennedale, Texas, according to plat recorded in Volume 388-A, page 130, Deed Records of Tarrant County, Texas, being a four foot wide strip of land along the northwest boundary line of said Lot 1 and four foot strip of land along the southeast boundary line of said Lot 2, be, and said utility ease -lent is hereby vacated and abandoned by the City of Kennedale, Texas. 2. That a certified copy of this ordinance be placed of record in the office of the County Clerk of Tarrant County, Texas, to evidence the vacation and abandonment of saidutility easement across Lots 1 and 2, Block 1, Woodlea Acres Addition to the City of Kennedale, Tarrant County, Texas, by said City of Kennedale, Texas. 3. That this ordinance shall be in effect immediately upon its passage and approval by the Mayor or Mayor Pro Tempore, duly attested by the City Secretary.
