O65-02KENNEDALE ORDINANCE O. 65-2 AN ORDINANCE VACATING AND ABANDONING THAT PORTION OF • SON STREET LYING *EDT-F:7N BLOCKS 29 AND 30, ORIGINAL TOWN OF KENN ALE, TARRANT COUNTY, TEXAS 10; WHEREAS, the owners of all adjacent property which would thereby be affected has petitioned the City Council of the City of Kennedale, Texas, to vacate and abandon that portion of a public street dedicated as Hudson Street the plat of the Origin.1 T.wn of Kennedale, Tarrant County, Texas, lying between Blocks 29 and 31, Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant County, Texas; and WHEREAS, the City Council, after due hearing and investigation, hs found and determined that such portion of Hudson Street, although dedicated by plat as a public street many years ago, has never been used or improved as a public thoroughfare, but has been continuously devoted to private use since such dedi- cation; that no public use or benefit will be served by the opening and improving of such portion of said dedicated street at this time, but that it would be to the public interest and convenience that such unused and abandoned portion of said dedicated street be vacate so that the same can be developed and improved for private purposes; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: 1. That the portion of Hudson Street lying between Blocks 29 and 30, of the Original Town of Kennedale, Tarrant County, Texas, as same appears of record in the Deed Records of Tarrant County, Texas, bounded on the North by the projected North boundary lines of said Blocks 29 and 30 (being also the South right-of-way line of Third Street), and bounded on the South by the projected South boundary lines of sai Blocks 29 and 30 (being also the North right-of-way line of Fourth Street), be, and such portion of said Hudson Street is hereby abandoned and vacated :s a public street and thoroughfare. 2. That no present need or necessity exists for a public street across such property, that such property has never been devoted or used as a public street, but has been continuously under private use since its dedication, and that the public interest and necessity v±11 best be served by the vacation of such portion of said street so that said property can be improved and d- eloped for private purposes. 3. That title, to the portion of said Hudson Street hereby vacated shall revert to the abutting owners of Blocks 29 and 30, or the portions thereof abutting such vacated street, respectively, so that said abutting owner shall henceforth own to the center of such vacated street, respectively.
