O65-01KENNEDALE ORDINANCE NO. 65-1 AN ORDINANCE CREATING THE KENNFDALE CITY PLANNING COMMISSION; PRESCRIBING THE DUTIES AND QUALIFICATIONS OF ITS MEMBERS, AND THEIR TERMS OF OFFICE; PROVIDING FOR THE APPOINTMENT OF ITS ME_HERS, THE METHOD OF FILLING VACANCIES, EKING DEPARTMENT .ii ;ADS AND OFFICIALS AVAILABLE TO THE CITY PLANNING COMMISSION, PRESCRIBING POWERS AND DUTIES OF THE CITY PLANNING COMMISSION, PROV I;SING FOR ADOPTION OF RULES AND REGULATIONS AND - LAWS, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT OR CONTRARY HERETO, AND PROVIDING A SAVINGS CLAUSE A '' EFFECTIVE DATE. BE IT ORDAINED BY T!at" CITY COUNCIL OF THE C ITY OF KENNEDA LE, TEXAS: Section 1. There is hereby created and established within the City of Kennedale, Texas, a City Planning Commission, which shall be subject to the jurisdiction of the City Council of the City of Kennedale, Texas. SaiCity Planning Commission shall be composed of five (5) members, whose offices are hereby created nd established. Said members shall be resident citizens of the City of Kennedale, Texas, owners of real estate situated within the City of Kennedale, tax -payers and qualified voters of the City of Kennedale, Texas. Members shall be appointed by the City Council. The term of office of members of the City Planning Commission shall be five (5) years; provided, however, at the initial meeting of the first five appointed members of the Commission, said members shall draw by lot to determine which of them shall serve one, two, three, four and five year terms, respectively, so that their terms shall expire in consecutive years; thereafter, one member shall be appointed each year for a full term of five years upon the expiration of the terms of each of the initial members. The City Council, in making appointments, shall designate one appointee as Chairman and one as Vice Chair of the Commission. All vacancies oc- curring on the City Planning Commission shall be filledby appointment of the City Council for the unexpired term of the vacating member. Members of the Commission shall receive $5.00 for each regular meeting attended in the performance of their duties, but no compensation shall be paid for special meetings. Section 2. The City Planning Commission sall recommend to the City Council the appointment of such individuals as 1.!y, in the opinion of the Commission, be necessary for the proper conduct, operation and undertakings of the City Planning Commission, including as it may find necessary a City Planning Consultant of recognized standing and ability. Said City Planning Consultant shall perform the duties prescribed by the City Planning Commission, subject to the approval of the City Council, and shall receive such compensation gas ,x-y be fixed by the City Council. Section 3. All department heads and offici,-als of the City of Kennedale shall be available to the City Planning Commission for advice and consultation, and they shall cooperate with and render such services for the City Planning Commission as shall reasonably come within the scope of the duties of said officials. They shall attend meetings of the City Planning Commission upon request of the Commission or its duly authorized re- presentative. Section 4. The City Planning Commission shall have the following powers,authority and duties: (1) To make studies and project plans for the improvement of the City of Kennedale, with a view to its development and extension, and to recommend to the City Council all matters for the development and the advancement of city facilities, lay- outs and appearanc-s, and to perform the duties imposed upon the City Planning Commission by the statutes of the State of Texas, and specifically by Chapter 231, Acts of Regular Session of the 40th Legislature, 1927, being also Article 974a, Vernon's Revised Civil Statutes of Texas. (2) To ke plans and ps of the whole or any portion of the City of Kenne- dale, and of land outside the City limits located within three (3) miles of said City limits, and any other land outside the City of Kennedale which in the opinion of the Commission bears a relation to the planning of the City of Kennedale, and to 1.ke such changes and additions and extensions of plans or maps within the City as it deems advisable. (3) To consult with and advise private property owners pertaining to location erection of privatestructures with the view of having the same conform to the over-all city plan, and to advise with the Building Commissioner and Inspector in the performance of his duties. (4) To aid and assist the City Secretary and City Coucil in the preparation of the City Budget, and determination of sources of funds and i the procuring of financial and other aid and assistance for the City froi, the State and Federal Government and their agencies for each and all of the purposes herein enumerated. (5) To act with and assist all other municipal and governmental agencies, and especially the City Council, in for,ulating and executing plans for municipal •fevelopment. (6) To plan and recommend te location, plan and extent of city alleyways, parks, play- grounds, airports, automobile parking places and other public grounds and improvements, for the location and planning of public buildings, schools and other properties, and of public utilities, including bus terminals, railway depots and terminals, whether public or private, water, lights, sanitation, sewage disposal, drainage, flood control, transportation, commu- nication and shipping facilities, and for the removal, relocation, widening, extension, narrowing, vacation, abandon- ment or changes of use of any of the foregoing public places, works, buildings, facilities or utilities. To select and recommend to the City Council routes of streets, avenues, and boulevards, and particularly to investigate and recommend the opening, widening or abandonment of streets, avenues, boulevards and alleyways, or the changing thereof to confor nr to the City's system, present and future, of all streets, avenues, boulevards, alley- ways and parks. To investigate, consider and report to the City Council upon the lay -out and plans of any new subdivision to the City of Kenny Bale, or property situated within three miles of the city limits, and to approve or reject all plans, plats or re fiats of additions within the city limits or within three miles thereof. (7) (8) (9) To recommend to the City Council for adoption, rules and regulations governing plats and subdivisions of land within the corporate limits of the City, or within three miles thereof, to promote health, safety, moral and general welfare of the community, and the safe, orderly and health- ful «evelopment of the community, which rules and regulations may be adopted by the City Council after public hearing held thereon. C1To recommend plans to the City Council for improving, developing, expanding and beautifying the parks, lakes and public buildings in or adjcent to th City, and to cooperate with the City Council and other agencies of the City in devising, establishing, locating, im- proing, selecting,expanding and maintaining public parks, works, playgrounds, lakes and other areas for public recreation. (11) To aid and .lssist the City Council by recommending plans for the development of civic centers, and to ke inesti- gations, consider and make recoendations to the City Council concerning traffic regulations, routing and control, and highway designations. (12) To investigto and establish zoning regulations for the entire City, and, from time to time, to review all zoning regulations, and make re- commend.tions on amendments, and to review and act on 11 exceptions permitted under zoning changes involving major land use. Section 5. Said City Planning Commission shall, subject to the approval of the City Council, ike such rules and regulations and adopt such by-laws for its own government, and designate sue timesand pl,ces for holding regular meetings, as it deems proper, but said regular meetings shall not exceed one meeting per month, and three members of the City Planning Com- mission shall constitute a quorum for transction of business at any special or regular meeting. Section 6. All ordinances and parts of ordinances inconsistent with or contrary hereto are hereby repealed, but only to the extent that the same are necessarily in conflict herewith. This ordinance -shall be in effect Il ediate- 1 y upon its passage and approval. Section 7. If any section, sub -section, sentence, clause, phrase or portion of this ordinance shall for any reason be help invalid or unconstitutional by any court of competent jurisdiction, such section, sub -section, sentence, clause, phrase or portion shall be deemed separate, distinct and independett from other provisions hereof, and such holding shall not affect the validity of the rem -wining portions hereof.
