AN ORDINANCE PRESCRIBING THE RATES TO BE CHARGED
FOR SEWER SERVICE RENDERED BY THE MUNICIPAL
SEWER SYSTEM IN THE CITY OF KENNEDALE, TEXAS;
PRESCRIBING PA' °ac NT OF A SECURITY DEPOSIT AND
INSTALLATION CHARGE AS A PREREQUISITE TO THE
GRANTING OF SEWER SERVICE; PRESCRIBING THE
.TIME FOR PAYMENT OF ACCOUNTS; PROVIDING A
PENALTY FOR FAILURE TO PAY ACCOUNTS; PROVIDING
FOR CONDITIONS UPON WHICH SERVICES WILL BE
RESUMED; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City. of Kennedale, Texas, is engaged in
the installation of a municipal sewer system, which will soon
be placed in operation; and
WHEREAS, it is deemed necessary for the City of Kenne-
dale to prescribe rates to be charged for said sewer service and
for connection of premises to said municipal sewer system; now,
therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KE;: 'ALE, TEXAS:
Section 1. There are hereby fixed and established for
each and every connection made to the sewer system of the City of
Kennedale, Texas, the following monthly charges:
(a) A monthly charge of'$2.00 for each
single -family -residence.
(b) A monthly charge of $2.00 per family
unit for each duplex or multiple -family
residence or apartment, whether served
through one or more water meters or sewer
lines.
(c) A minimum monthly charge of $2.50
for each industrial, business, commercial
or other non-residential establishment,
plus an additional monthly charge based
upon the volume of water used by the establish-
ment during the month in accordance with the
following schedule:
(1) Fifteen cents (150) per each
1,000 gallons, or fraction thereof,
of water used in excess of 5,000
gallons, but not exceeding 50,000
gallons of total water used during
the month.
(2) Ten cents (10¢) per each 1,000
gallons, or fraction thereof, of
water used in excess of 50,000
gallons, but not exceeding 100,000
gallons of totalFater used.
(3) Five cents (5$) for each 1,000
gallons, or fraction thereof, of
water used in excess of 100,000
gallons.
(if such establishment does not use more than
5,000 gallons of water during the month, the
minimum monthly charge of $2.50 will apply.)
(d) Any business or industrial establish-
ment intending to discharge wastes in the
municipal sewer system of an unusual character
or volume, and particularly of a character
that might be burdensome or detrimental to
the operation of the municipal sewer plant,
shall, upon written notice from the City
Secretary, negotiate special rates for
sewer service by contract with the Kenne-
dale City Council, such rates to be fairly
fixed in accordance with the foregoing rates
and the anticipated burden of such industrial
or business use upon the sewer system.
Section 2. Each person, firm or corporation making
application for a connection with the municipal sanitary sewer
system of the City of Kennedale, Texas, for property or premises
not previously connected with said sewer system, regardless of
whether it is necessary to tap the City sewer main or not, shall
pay the City an installation or tap fee of Fifty and N2/100
Dollars ($50.00); provided, however, that all applicants for sewer
service who actually make connection with the sewer system prior
to May 1, 1961, shall be exempt from said installation or tap
fee. Monthly sewer service charges shall begin to accrue im-
mediately upon connection to the Kennedale Sanitary Sewer
System, if the System is then in operation, and if not, then
immediately upon the Kennedale Sanitary Sewer System being
put into operation.
Section 3. Monthly bills for sewer service shall
be rendered and payable jointly with bills for water service,
and sewer service shall be subject to discontinuance if the
charges therefor are not paid by the 20th day of the month in
which they become due. Discontinuance of sewer service for non-
payment of the sewer bill shall be accompliShed by shutting
off the water supply to the involved. premises if such premises
are connected with the municipal water system, and if not, then
by disconnecting saidiremises from the municipal sewer system.
In event of discontinuance of sewer service for non-payment,
as herein provided, such service shall not be resumed until
all charges due for water and sewer service are paid, together
with the additional sum of One and No/100 Dollar ($1.00) for
resumption of water and sewer service if the premises are
connected to both the municipal water and sewer system, or
the additional sum of One and No/100 Dolar ($1.00) plus the
actual cost to the Cityof Kennedale of disconnecting and
reconnecting said premises to the sewer system if the in-
volved premises are served only by the municipal sewer system,
and not by the municipal water system.
Section 4. Each applicant for sewer service shall
deposit with the City of Kennedale the sum of Five and No/100
Dollars ($5.00) if the connection is to a private residence,

and the sum of Ten and No/100 Dollars ($10.00) if the connection
is to an industrial, business, commercial or other non-residential
establishment, to guarantee the payment of monthly sewer service
charges; provided, however, that if the applicant shall already
have on deposit in his name with the City of Kennedale an equal
or greater amount to guarantee the pa,oent of water services
rendered to the same premises, it will not be necessary for such
applicant to make an additional deposit to guarantee sewer ser-
vice payments, but in such event, the application for and/or
connection of premises by the applicant to the municipal sewer
system without the posting of an additional sewage security
deposit shall constitute an agreement that the water security
deposit may also be applied toward the payment of any sewer
service charges owing by said applicant. A separate security
deposit shall be required with respect, i* each separate property
or premises, residence or non-residen *landing for which appli-
cation is made to connect to the sewer system. The City shall
have the right to apply such security deposit to the payment of
any water or sewer service charges owing by the depositor, and
upon discontinuance of water and/or sewer service to the depositor,
any portion of such deposit not so applied shall be refunded to him.
Section 5. All accounts for sewer service shall be pay-
able on or before the 10th day of each month at the office of the
City Secretary in the City of Kennedale, Texas, for services
rendered the preceding month.
Section 6. This ordinance shall take effect from and
after its passage and approval.
