O60-08NRDALE ORDINANCE NO. 60-8 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OFEENNEDALE, TEXAS; PROVIDING T SUCH AREA SHALL BE MADE A PART OF SAID CITY AND THAT THE OWNERS AND IN- HABITANTS THEREOF SHALL BE ENTITLED TO ALL THE PRIVILEGES OF 0 R PROPERTY OWNERS AND CITIZENS OF SAID CITY, AND SHALL BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED; FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID CITY AS HERETOFORE ADOPTED, AND FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Article 974, Texas Revised Civil Statutes of 1925, as amended, G.H. Schaefer, Dorothy Schaefer,, and Ophia L. Stark, each of whom is an inhabitant aria propertymner in the hereinafter described territory, and each of whom is qualified to vote for members of the State Legislature,has heretofore filed with the Mayor of the City of Kennedale, Texas, an affidavit reciting that an election has been held in and among the inhabitants of said hereinafter described territory, who are qualified to vote for members of the State Legislature, and that a majority of such inhabitants who are so qualified to vote have voted in favor of said herein- after described territory becoming a part of the City of Kennedale, Texas, which affidavit has been duly certified by the Mayor to the City Council of said City of Kennedale, Texas; and WHEREAS, the City Council of the City of Kennedale, Texas, as provided by law, has duly and legally considered the same, and it appearing to the City Council that all statutory requirements in connection with said affidavit and the annexation of said hereinafter described territory have been fulfilled, that an election was in fact held as recited in said affidavit, that a majority of the inhabitants of the said territory, quali- fied to vote for members of the State Legislature, have voted in favor of annexation, that said territory is adjacent to the present boundaries of the City of Kennedale, Texas, and is not more than one-half mile in width, and that it would be to the best interest of the City of Kennedale and its inhabitants, as well as the inhabitants of said territory, to annex the same, all of which the City Council so finds; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section.l. That the hereinafter described territory, lying adjacent to the existing boundaries of the City of Kennedale, Texas, be, and the same is hereby annexed and brought within the corporate limits and hereby made an integral part of the City of Kennedale, Texas, said land and territory being described by metes and bounds as follows, to -wit: BEING a tract of land out of the F. Wood Survey, Abstract No. 1628, and the E.C. Cannon Survey, Abstract No. 378, Tarrant County, Texas, and more particularly described by metes and bounds as follows, to -wit: BEGINNING at the intersection of the present southerly corporate limit line of the City of Kennedale, Texas, and the northeasterly right-of-way line of the Mansfield Card. Road (also known as the Old Mansfield Highway) (County Road No. 2033); THENCE southeasterly along the northeasterly right-of-way line of said Mansfield Card. Road to its intersection with the east line of the F. Wood Survey; THENCE south along the east line of said F. Wood Survey to a point for corner, said point being 49 varas north of the southeast corner of said F. Wood Survey and also being the northeast corner of a tract conveyed to E.B. Cornell by Ophia L. Stark by deed recorded in Volume 3253, at page 283, Deed Records of Tarrant County, Texas; THENCE west with the north line of said Cornell tract to its northwest corner in the west line of said F. Wood Survey,said point being 49 varas north of the southwest corner of said Wood Survey; THENCE north with the west line of said F. Wood Survey to a point in said west line 561 feet south of the centerline of the said Mansfield Card. Road (County Road No. 2033), said point being the southeast corner of a tract deeded to G.H. Shaefer and wife, Dorothy Schaefer, by H.R. French and wife, Flora French, by deed recorded in Volume 2536, page 211, Deed Records of Tarrant County, Texas; THENCE north 78 deg. 4+5 min. west with the south boundary line of said Schaefer tract 140.2 feet to the southwest corner of said Schaefer tract; THENCE north 37 deg. 56 min. west (said line being approximately parallel to and equidistant from the centerline of said Mansfield Car. Road) to the southerly corporate limit line of the City of Kennedale, Texas; THENCE easterly with the southerly corporate limit line of the City of Kennedale, Tdxas, to the place of beginning. Section 2. That the owners and inhabitants of the area hereinabove described and annexed shall be entitled to all the rights and privileges of other owners and citizens of the City of Kennedale, Texas, and shall be bound by all of the acts and ordinances of the City of Kennedale now in full force and effect and that may be hereafter adopted. Section 3. That the official map and boudaries of the City of Kennedale,.Texas, as heretofore adopted, be, and the same are hereby corrected and amended so as to include the hereinabove described area and territory as a part of the City of Kennedale, Texas. Section 4. This ordinance shall become effective immediately upon its passage and approval by the Mayor, duly attested by the City Secretary. That said election was held by the circulation of a petition among the inhabitants of said territory, as well es the owners thereof, the petition attached hereto being that circulated in said election, and that the circulation of said petition was a method of election satisfactory to a majority of the inhabitants of said territory aualified to vote for members of the State Legislature. That every inhabitant of said territory oualified to vote for members of the State Legislature was giver an opportunity to vote in said election, and that a majority of the inhabitants of said territory qualified to vote for members of the State Legislature, and in fact all of said in- habitants unanimously, voted in favor of annexation of said territory to the City of Kennedale, Texas.
