Vernon's Texas Civil Statutes of 1925, as amended, Raymond
Rufus Swiney and wife, Polly Leodia Swiney, being all of
the owners of real property hereinafter described, have
made application as by law provided to the Mayor and City
Council of the City of Kennedale, Texas, requ'sting annexation
to said City of Kennedale of the area situated in the County
of Tarrant, State of Texas, more particularly described as
follows, to -wit:
A tract or parcel of land, being a portion of the DAVID
STRICKLAND SURVEY, Abstract No. 1376, in Tarrant County,
Texas, to include a portion of the right-of-way of U.S.
Highway No. 287, and all that certain tract of approximately
;160 acres conveyed by Walter A. Williams and -wife, Nettie
Williams, to Raymond Rufus Swiney and wife, Polly Leodia
Swiney, by deed recorded in Vol. 1875, Page 532, Deed Records
of Tarrant County, Texas, and being 'further described by
metes and bounds as follows:

BEGINNING at the Northwest corner of the J. Prickett Survey,
Abstract No. 1225, and the Northeast corner of Block 56,
of the Shelby County School Lands, situated in Tarrant County,
'!texas, said point being also the present corner of the City
Limits of Kennedale, Texas;

said Block 56 of the. Shelby County School Lands, to the
Southerly right-of-way line of U.S. Highway No. 287;

and egress thereto, which said one acre tract is des-
cribed in a certain Warranty Deed dated August 10,
1949, and executed by Raymond Rufus Swiney and wife,
Polly Leodia Swiney, to Texas Electric Service Company,
a corporation, which said deed is recorded in Vol.
2116, Page 306 of the Deed Records of Tarrant County,
Texas,
2. BEGINNING at a point in the Northeast corner of a 21.13
acre tract of land conveyed by Raymond Rufus Swiney
and wife, Polly L. Swiney, to 0rlaf'E. Atchison and
wife, Nina D. e tchipon, dated April 25, 1956, and
recorded in Vol. 3007, Page 551 of the Deed Records
of Tarrant County, Texas, said point of beginning also
being the center of Village Creek;
CE West along the North line of said 21.13 acre
tract a distance of 525 feet to a point;
NCE South 409.3 feet to a point in the South line
of said 21.13 acre tract;
THENCE East 755 feet along the South line of said
21.13 acre tract to the center of Village Creek;
THENCE in a Northwesterly direction up Village Creek as
follows:
North 41 degrees 35 minutes West a distance of 324.5
feet;
North 11 degrees 30 minutes West 170 feet to the
place of beginning.
3. A one acre tract of property out of the 160 acre tract
above described, which said one acre tract is fully
described in a certain Warranty Deed dated August 30,
1957, and executed by Raymond Rufus Swiney and w!fe,
Polly Leodia Swiney, to the 8ilton Construction Company,
Inc., which said deed is recorded in Vol. 3141, Page
582 of the Deed Records of Tarrant County, Texas.
4. A 1.04 acre tract of property out of the 160 acre tract
above described, which said 1.04 acre tract is fully
described in a certain Warranty Deed dated January 3,
1959, and executed by Orlaf E. Atchison and wife, Nina D.
Atchison, to J. Garrell Adams, which said deed is re-
corded in Vol. 3286, Page r09 of the Deed Records of
Tarrant County, Texas.
5. A tract or parcel of land out of the David Strickland
Survey, Abstract No. 1376, Tarrant County, Te;, and
being also a portion of that certain tract of approxi-
.tely 160 acres conveyed by Walter A. Williams and
wife, Nettie Williams, to Raymond Rufus Swiney and
wife, Polly Leodia Swiney, by deed recorded in
Vol. 1875, Page 532, Deed Records of Tarrant County,
Texas, and being more particularly described as follows:
BEGINNING at a point in the North right-of-way line
of U.S. Highway No. 287, said point being North 41
degrees 52 minutes West a distance of 1423 feet
from the Southeast corner of the said Swiney tract;
CE continuing along the said North right-of-
way line of U.S. Highway 287 a distance of 210.0
feet to a point for corner;

dicular to said North right-of-way line of U.S.
Highway No. 287 a distance of 207.43 feet to a
point for corner;

6. A 3.49 acre tract of property out of the 160 acre
tract above described, which said 3.49 acre tract is
fully described in a certain Warranty Deed dated
August 8, 1951, and executed by Raymond Rufus Swiney
and wife, Polly Leodia Swiney, to the Texas Electric
Service Company, a corporation, which said deed is
recorded in Vol. 2342, Page 453, Deed Records, Tarrant
County, Texas.
7. A parcel or tract of property out of the 160 acre tract
above described, which said parcel or tract lies ad-
jacent to Village Creek, following and lying below
the 560 foot elevation line above sea level, which
said tract or parcel of land is fully described
in a certain Flood Easement, dated October 3, 1956,
and executed by Raymond Rufus Swaney and wife,
Polly Leodia Swaney, and 0rlaf E. Atchison and wife,
Nina D. Atchison, to the City of Arlington, which
said Flood Easement is recorded in Vol. 3046, Page
366 of the Deed Records of Tarrant County, Texas.

WHEREAS, the City Council, as provided by law, at a
regular meeting on this the 5th day of May, 1960, the same being
more than five and less than thirty days after the filing of
the application for annexation with'the City of Kennedale, duly
and legally considered the said petition, hearing the arguments
for and against such annexation, and it appearing to the City
Council of the City of Kennedale, Texas, that all statutory
requirements in connection with said application and petition
have been fulfilled and that all of said area, on which less
than three (3) qualified voters reside, is adjacent and conti-
guous to the present existing boundaries and limits of the
City of Kennedale, and is not more than one-half mile in width,
all of which the Council so finds; now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
Section 1. That the property hereinabove described
lying adjacent and contiguous to the present existing boundaries
and limits of the City of Kennedale, Texas, be,and the same is
hereby annexed and brought within the corporate limits and made
an integral part of the said City of Kennedale, Texas.
Section 2. That the owners and inhabitants of the area
herein annexed be, and they are hereby declared entitled to all
the rights and privileges of other property owners and citizens
of said City of Kennedale, Texas, and shall be bound by all the
acts and ordinances of said City of Kennedale which are now in
force and effect, and which may be hereafter adopted.
Section 3. That the official map and boundaries of the
City of Kennedale, Texas, as heretofore adopted and amended, be
corrected and amended, so as to include the above described area
and territory as a part of the City of Kennedale, Texas.
Section 4. t this ordinance shall become effective
from and after its passage and approval by the Mayor, duly attested
`by the City Secretary.

I, Susie A. Langford, City Secretary of the City of
Kennedale, Texas, hereby certify that the above and foregoing is
a true and correct copy of Kennedale Ordinance N-o. 60-5 unanimously
adopted by the City Council of the City of Kennedale, Texas, at
a regular meeting held at the Kennedale City Hall on the 5th day
of May, 1960, at which meeting a quorum was present, as is reflected
by the minutes of said meeting.
PETITION FOR ANNEXATION
TO THE HONORABLE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS:
WE, the undersigned, being all of the owners of the
hereinafter described land and territory lying contiguous and
adjacent to the existing corporate limits of the City of
Kennedale, Texas, hereby petition the Mayor. and City Council
of the City of Kennedale, Texas, to institute all proceedings
and to adopt all ordinances and do all other things necessary
to annex said hereinafter described land and territory and
make the same a part of the City of Kennedale, Texas.
Petitioners would show the said Mayor and City Council
of the City of Kennedale, Texas, and Petitioners here aver, that
the said hereinafter described property is contiguous and ad-
jacent to the present city limits of the City of Kennedale,
Texas, and is less than one-half mile in width, and that less
than three qualified voters reside on said land and territory,
and that the same is not now within the limits of any in-
corporated municipality.
The land and territory hereby requested to be an-
nexed to the City of Kennedale, Texas, is more particularly
described as follows, to -wit:
