O60-03ORDINANCE NO. 60-3 AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OF KENNEDALE, TEXAS; PROVIDING THAT SUCH AREA SHALL BE MADE A PART OF. SUCH CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE EN- TITLED TO ALL T} PRIVILEGES OF OTHER PROPERTY OWNERS AND CITIZENS OF SAID CITY AND SHALL BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TOBE HEREAFTER ADOP- TED; FURTHER PROVIDING FOR, AMENDING AND CORRECTING THE OFFICIAL. BOUNDARIES. OF SAID CITY AS HERETOFORE ADOPTED, AND.FOR AN EFFECTIVE DATE. WHEREAS, pursuant to provisions of Article 974-g, Vernon, Texas Civil Statutes of 1925, as amended, James A. -Arthur and Ro- bert William Bowies, being all of the owners of real property hereinafter described, have made application as by law provided to -theMayor and City Council of the City of Kennedale, Texas, requesting annexation to said City of the area situatedin the County of Tarrant, State of Texas, described as follows, to -wit: BEING fifty-three acres of land out of the E. R. Mingus Survey in Tarrant County, Texas, described by metes and bounds as follows: BEGINNING at a spike, the southwest corner of the E..R Mingus Survey in the center of county road No. 2065, said spike being 25 feet south, 89-43 west from the northwest corner of Lot 1, Block 1, Crestdale Addition to the City of Kennedale, Tarrant County, Texas, as shown in Vol. 1923, Page 49, Deed Records, Tarrant County, Texas; THENCE north 89-43 east at 25 feet the northwest corner of said Lot, in all with the north lines of Blocks 1 and "K" Crestdale Addition, and fence line 1486.0 feet a Stake; THENCE north 89-03 east with the north lines of Said Block "K't and Blcick "L", at 853.4 feet the northeast corner of said Mock "Lit as shown in Vol. 388-12,-Page 21, Deed Records of Tarrant County, Texas, in all 1260.9 feet an iron pin, the southeast corner of the E. R. Mingus Survey; THENCE north 0-30 east with fence line 839 feet an iron pin, in the east line of the E. R. Mingus Survey; THENCE south 89-03 west 1268.3 feet an iron pin; THENCE south 89-43 west 1486 feet :to the center of said county road and -the west line of said Mingus Survey; THENCE south with the center of said road and the west line of said Mingus Survey. 839 : feet to the place of beginning; being the same land described in a warranty deed dated December 30, .1959, by A. J. Moren to James A. Arthur and Robert William Bowles, recordedin Vol. 3403, Page 460, Deed Records, Tarrant County, Texas; SAVE AND EX- CEPT that portion off the west end -of said tract which is already within the existing corporate li- mits of the City of Kennedale, Texas. WHEREAS, the City Council, as provided by law, at a regular meeting on this the 3rd day of March, l, duly and legally considered the said petition, hearing the arguments for and.against such annexation, and it appearing to the City Council of the City .of Kennedale, Texas, that all statutory requirements in connection with said application and petition have been ful- filled and that all of said area, on Which leSs than three quali- fied voters reside, is adjacent and contiguous to the present existing boundaries and limitsof said City, and iS not more' than one-half mile in width, all of which the Council so finds; now, therefore: BE IT ORDAINED BY THE CITY COUNCIL OF KENNEDALE, TEXAS: Section 1. That the property hereinabove described lying adjacent and contiguous to the present existing boundaries and limits of the City of Kennedale, Texas, be, and the same is hereby annexed and broUght within the corporate limits and made an integral part of the said City of Kennedale, Texas. Section 2. That the owners and inhabitants of the area herein annexed be, and they are hereby declared entitled to all -the rights and privileges' of other property owners and citi- zens of said City of Kennedale, Texas, and Shall be bound by all the acts and ordinances of said City of Kennedale whiCh are now in force and effect, and which may be hereafter adopted. Section 3. That the official map and' bOundaries Of the city of Kennedale, Texas, as heretofore adopted and amended, be correctedand amended, so as to include the above -described area and territory as a part of the City of Kennedale, Texas. Section 4. That it appears to the City Council that the west 300 feet of the hereinabove described tract of land Was heretofore a part of the previously existing corporate limits of the City of Kennedale, Texas, but -it is nevertheless the inten- tion -of this City Council that this Ordinance shall hereby annex to and make a part of the City of Kennedale, Texas, all of the hereinabove described land and territory. Section 5. That this ordinance shall become effective from and after itS passage and approval by the Mayor, duly at- tested by the City Secretary. ADOPTED AND APPROVED this 3rd day of March, A.
