O59-03ORDINANCE NO. ,5' AN ORDINANCE RECEIVING AND ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY OF KENNEDALE, TEXAS; PROVIDING THAT SUCH AREA BE MADE A PART OF SAID CITY AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO ALL THE PRI- VILEGES OF OTHER PROPERTY OWNERS AND CITIZENS OF SAID CITY AND SHALL BE BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND TO BE HEREAFTER ADOPTED; FURTHER PROVIDING FOR. AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF SAID CITY AS HERE- TOFORE ADOPTED, AND FOR AN EFFECTIVE DATE. WHEREAS,pursuarittoprovisionsofArticle974-s,mon's TexasCivil Statutes of 1925, as amended, Tommie L. Gay and wife, Linda F. Gay, being all of the owners of real property hereinafter described, have made application as by law provided to the Mayor and City Council of the City of Kennedale, Texas, requesting an- nexation to said city of the area situated in the County of Tarrant, State of Texas, described as follows, to -wit: BEING a part of the M. F. Scott Survey, Abstract No. 1450, Patent No. 504, Volume 26, in Tarrant County, Texas, ad- joining the present boundary line of the corporate limits of the City of Kennedale, Texas, and more particularly de- scribed as follows: BEGINNING at the Southeast corner of lot 13 and Southwest corner of lot 41 of the "Gay Daughters' Subdivision, being also Southeast corner present city limits of Kennedale, Texas; THENCE North 448 feet to an iron pin at the Northwest corner lot 28 of said subdivision and in the East line of present city limits of Kennedale, Texas; THENCE East 501.2 feet to an iron pin at the Northeast corner 'of lot 34 of said subdivision; THENCE South 459.9 feet to an iron pin at the Southeast corner of lot 35, also being the Southeast -corner of the M. F. Scott Survey; THENCE North 88 degrees 43 minutes West 504.1 feet to the place of beginning; and containing 5.20 acres of land, more or less. WHEREAS, the City Council, as provided by law, at a regular meeting on the 5th day of June, 1959, duly and legally considered the said petition, hearing the arguments for and against such annexation, and it appearing to the City Council of the City of Kennedale, Texas, that all statutory requirements in connection with said application and petition have been fulfilled and that all of said area, on which not more than three qualified voters reside, is adjacent and contiguous to the present existing boundaries and limits of said City, and is not more than one-half mile in width, all of which the Council so finds; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENNEDALE, TEXAS: Section 1. That the property hereinabove describedlng adjacent and contiguous to the present existing boundaries and limits of the City of Kennedale, Texas, be, and the same is hereby annexed and brought with- in the corporate limitqand made an integral part of the said City of Kennedale, Texas. Section 2. That the owners and inhabitants of the area herein annexed be, and they are hereby declared entitled to all the rights and privileges of other property owners and citizens of said City of Kenne- dale, and shall be bound by all the acts and ordinances of said City of Kennedale which are now in full force and effect and which may be hereafter adopted. Section 3. That the official map and boundaries of the City of Kennedale, Texas, as heretofore adopted and amended, be corrected and amended, so as to include the above described area and territory as a part of the City of Kennedale, Texas. Section 4. That this ordinance shall become effective from and after its passage and approval by the Mayor, duly attested by the City Secretary. ADOPTED AND APPROVED this 5th day of June, A.D. 1959. PETITION FOR ANNEXATION TO THE HONORABLE CITY COUNCIL OF THE CITY OF KENNEDATF,, TEXAS: We territory, Kennedale, ordinances described Kennedale, bounds as the undersigned owners of the hereinafter described land or hereby petition the Mayor and City Council of the City of Texas, to institute all proceedings and to adopt all and do all other things necessary to annex said hereinafter land and territory and make the same a part of the City of Texas, said land and territory being described by metes and follows, to -wit: BEING a part of the M. F.
