AND PRESCRIBING A NETN.R FFF DEPOSIT. TO BE ESCROWED BY TER USER WITH THE CiTY DURING THE PERIOD OF. USE OF THE METER BY THE USER; AND.RESTRICTINlG THE. SITE OF PRIVATE LINES TO BE AUTHORIZED AND INSTALLED; AND RESCINDING, REVOKING, AND VOIDING A17, PRIOR ORDNANCES, MINUTES OR RESOLUTIONS IN CONFLICT HEREWITH AND CONTAINING THE USUAL SAVINGS CLAUSE. WHEREAS, the City of Kennedale, Texas, is at the present time in the process of installing a water system, in the City of Kennedale, Texas, and will within a reasonable time hereafter make water available to the citizens of Kennedale as users of the system and water therefrom; and WHEREAS, the City of Kennedale will incur certain expense in the connection of each private water line to the main_ line by way of required equipment, labor and meters; and WHEREAS, the City of Kennedale will incur greater expense in connection with the installation of water on a graduated cost basis depending on the size of the water line installed. SAS, the City of Kennedale has available a limited supply of water only and that said limit exists partly by reason of the limited size of the main line through which the water flows and that to allow any user the use of a private line of greater size than two (2) inches in diameter would lessen the amount of water and the pressure in the water system to other users. UHEREAS, it is necessary for the city to require a water meter deposit to be escrowed by each user with the city to prevent users terminating water service from not paying accrued water charges at time of termination of said service. NOW THEREFORE BE IT ORDAINRD BY THE CiTY COUNCIL OF TEE CITY OF KENNEDAT,F, TEXAS, AS FOLLOWS SECTION 1 1. There shall be assessed, charged and collected from each user of water as charges and expense for connecting a private water line the following graduated fee depending on the size of the water line requested by the user and installed by the city, togrit: three-quarter (3/4) inch line or less 1 ®-00 one (1) inch line ;':00• one and one-fourth (1 1/4) inch line 5 one and one-half (1 1/2) inch line `.`A two (2) inch line y90- 00 -- . said services to be rendered by the city to the user for and in considera- tion of above stated consideration shall be as follows: (1) opening and closing ditch between main line and point of water meter (2) furnishing and installing copper tubing between main line and meter (3) furnishing and installing a water tap (4) furnishing and stalling curb and cock (5) furnishing and installing meter box (6) furnishing and installing meter and (7) furnishing labor. SECTION 11 There shall be required of each user of water from the City Water Works that he place in escrow with the City Clerk a meter deposit, which said deposit shall be received and collected by the City Clerk -prior to the i nstall l ation of a peter and the allowance of any use of water by the user, the following graduated sum of money depending on the size of the water line requested by the user and installed by the City,to-wit: three -fourth (3/4) inch line or less ytoit e one (1) inch line 310 0 00 one and one-fourth (1 1/4) inch line 10 ®00 one and one-half (1 1/2) inch line s © 0 two (2) inch line 25.00 -- that the city shall keep accurate records of the money deposited with it under this escrow requirement and will, at the time said user ceases to use said water, refund said deposit to said user; provided, however, that upon said termination date, should the user owe the city any money for use of water furnished the city may deduct said charge from the deposit bdfore making a refund of said deposit. SECTION 111 There shall not be authorized nor installed by the City of Kennedale any private line to any user a private line of greater size than two (2) inches in diarnenter, there shall further not be authorized no& installed by the City of Kennedele any private line to any user a private line of greater size than five -eights (5/8) inches in diarenter at any place in the City where the private line is furnished by a main line of three (3) inches in diamenter or less. SECTION 1V That all ordinances, minutes or resoltttions heretofore passed and placed in affect by the City Council of the City of Kennedal e in conflict with the terms of this ordinance are hereby rescinded, revoked and voided. o SECTION V Should any part, portion, section or part of a section of this ordinance be declared invalid or inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts,sections or parts af sec- tions of this ordinance, which provision shall be, remain and continue to be in full force and effect. SECTION VT This ordinance shall become effective and be in full force and effect from and after the date of its adoption. Adopted this 6th day of February, A. D. 1953.
