AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS
ESTABLISNFT) FOR VEHICLES UNDER THE PROVISIONS OF
SECTION 8 OF ARTICLE 827a, VERNON'S TEXAS PENAL CODE,
UPON THE BASIS OF AN ENG r :;WING AND. TRAFFIC INVESTI
GATION, UPON. CERTAIN STREETS AND HIGHWAYS, OR. PARTS
THEREOF, WITHIN THE CORPORATE_Lfl11ITS OF THE CITY OF
KENNEDALE,_AS_SET.OUT IN THIS ORDINANCE;. AND PROVID-
ING A PENALTY OF A FINE NOT. TO EXCEED $100 FOR THE
VIOLATION OF THIS ORDINANCE.
Section 8 of Article 827a, Vernonts Penal Code of the State of
Texas, provides that whenever the governing body of the City shall determine
upon the basis of an engineering and traffic investigation that any prima
facie speed therein set forth is greater or less than is reasonable or safe
under the conditions found to exist at any intersection or other place or
upon any part of a street or highway within the City, taking into consider-
ation the width and condition of the pavement and other circumstances on
such portion of said street of highway, as well as the usual traffic there-
on, said governing body may determine and declare a reasonable and safe
prima facie speed limit thereat or thereon by the passage of an ordinance,
which shall be effective when appropriate signs giving notice thereof are
erected at such intersection or other place or part of the street or high-
way, now therefore,
BE IT ORDAINED by the City Council of the City of Kennedale, Texas:
Section 1. Upon the basis of an engineering and traffic investigation here-
tofore made as authorized by the provisions of Section 8 of Article 827a,
Vernonts Texas Penal Code, the following prima facie speed limits hereafter
indicated for vehicles are hereby determined and declared to be reasonable
and safe; and such speed limits are hereby fixed at the rates of speed in-
dicated for vehicles travelling upon the named streets and highways, or
parts thereof, described as follows:
(1) On United States Highway 287 from a point where said
Highway enters said City in the northwestern boundary
thereof in a southeastern direction along said Highway
0.79 riles, 50 miles per hour.
(2) 0n United States Highway 287 from a point 0.79 miles
southeast from where said Highway enters the north-
western boundary of said city in a southeasterndirec-
tion a distance of 0.97 miles, 45 miles per hour.
(3) On United States Highway 287 from a point 1.76 miles
southeast from where said highway enters the north-
western boundary of said city in a southwestern direc-
tion a distance of 0.24 miles to the southeastern
boundary of said city, 55 miles per hour.
(4) On United States Highway 287 for a distance of 0.25
miles adjacent to the Kennedale Public School during
school hours and while a portable school warning sign
is placed on said highway only, 35 miles per hour.
(5) On all other streets, highways, roads and alleys in
the city of Kennedale save and except that highw:AT
above described, 35 miles per hour.
Section 2. Any person violating any of the provisions of this ordinance
shall, upon conviction thereof, be fined in any sun not more than One
Hundred ($100.00) Dollars.
